September 12, 2002 COUNTRY DESCRIPTION: Namibia is a southern African country with a moderately developed economy. Facilities for tourism are good and generally increasing in quality. The capital is Windhoek. ENTRY/EXIT REQUIREMENTS: A passport and visa are normally required. Bearers of U.S. passports who plan to visit Namibia for tourism for less than ninety (90) days can obtain visas at the port of entry and do not need visas prior to entering the country. Travelers coming for work, whether paid or voluntary, must obtain their visas prior to entering Namibia. Travelers should obtain the latest information from the Embassy of Namibia at 1605 New Hampshire Avenue, N.W., Washington, D.C. 20009, telephone (202) 986-0540, or from the Permanent Mission of Namibia to the U.N. at 135 W. 36th St., New York, NY 10016, telephone (212) 685-2003, fax (212) 685-1561. Overseas, inquiries should be made at the nearest Namibian embassy. In an effort to prevent international child abduction, many governments have initiated procedures at entry/exit points. These often include requiring documentary evidence of relationship and permission for the child's travel from the parent(s) or legal guardian not present. Having such documentation on hand, even if not required, may facilitate entry/departure.

The constitution of 1990 established Namibia as an independent republic. According to the constitution, Namibia’s president is the executive and is elected by the voters. The president may serve a maximum of two terms of five years, although a constitutional amendment approved in 1998 granted an exception to the current president, Sam Nujoma, allowing him to run for and win a third term in 1999. Legislative authority is vested in the National Assembly, a body made up of 72 elected members and up to 6 appointed representatives. The National Council, made up of two representatives from each of Namibia’s 13 regional councils, acts as an advisory body.

NAMIBIA Namibia's reputation as a role model for press freedom in southern Africa, thanks largely to its liberal constitution, took another beating in 1999, as both domestic and foreign conflict had negative repercussions on local media.
In January, Prime Minister Hage Geingob admitted in a letter to the independent daily Namibian that the Ministry of Defense was deliberately withholding information from all domestic media concerning Namibia's involvement in the conflict in the Democratic Republic of Congo (DRC). The prime minister claimed that the Namibian press had published "distortions" about the conflict in the DRC and that news published in the Namibian also appeared on the Internet and was therefore accessible to DRC rebel forces.
In March, Nathaniel Maxuilili, a member of Parliament from the ruling South West African People's Organization (SWAPO), threatened to ban a popular Oshiwambo-language talk show for airing what he called "nonsense" about the country's involvement in the DRC. "If I ask the government to stop [the talk show], it will," said Maxuilili at a Defense Ministry press briefing (reported in the Namibian ), At the same press conference, Maxuilili also reprimanded journalist John Grobler for asking "silly questions" about the role of Namibian troops in the DRC conflict.

    GOVERNMENT
    After 80 days, the Constituent Assembly produced a constitution which established a multi-party system and a bill of rights. It also limited the executive president to two 5-year terms and provided for the private ownership of property. The three branches of government are subject to checks and balances, and a provision is made for judicial review. The constitution also states that Namibia should have a mixed economy, and foreign investment should be encouraged.
    While the ethnic-based three-tier South African-imposed governing authorities have been dissolved, the current government pledged for the sake of national reconciliation to retain civil servants employed during the colonial period. The government is still organizing itself both on a national and regional level.
    The Constituent Assembly converted itself into the National Assembly on February 16, 1990, retaining all the members elected on a straight party ticket.
    The judicial structure in Namibia parallels that of South Africa. In 1919, Roman-Dutch law was declared the common law of the territory and remains so to the present.
