The fundamental purpose of The Label newsletter is to disseminate pesticide related information and encourage the multiplier effect via Extension communication channels to clientele. It is intended to serve as a source for subsequent news releases by Extension co-workers and to inform pesticide applicators and consumers. Topics related to pest management, new developments, pesticides, pesticide education, water quality, regulations, and more are included in the newsletter. Another purpose of this newsletter is to maintain of open communication channels to University administration and governmental representatives at state and federal levels. A succession of federal laws has addressed pesticides and their use in the United States. The Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) was first approved in 1947 and has undergone several revisions. FIFRA and the Nebraska Pesticide Act, which was enacted in 1993, are the principal statutes governing pesticide use in Nebraska.. FIFRA Congress intended FIFRA to protect both people and the environment by providing for controlled use of pesticides. The law contains provisions for pesticide registration, classification, labeling, distribution, use, disposal, and other topics. Those sections pertaining to pesticide users broadly address key issues: user categories, recordkeeping, certification, and penalties for violations. General Provisions FIFRA requires pesticide manufacturers to register each of their products with the U.S. Environmental Protection Agency either as a general use (GUP) or restricted use (RUP) pesticide with the exception of a few minimum-risk active ingredients. In some cases, a pesticide's active ingredient may be registered for both general and restricted use.

Bad Decision On Sad Case
Following State Law Over Federal law The Eighth Circuit Court of Appeals reported a decision September 24, 2001 in Costello v. Mitchell Public Schools (Nebraska) . They found against the plaintiff parents in virtually all regards. We urge on this website, in our manuals, and in our workshops for parents to learn and use the Federal Law. The Federal law is Supreme the U.S. Constitution has a "supremacy clause" at Article VI paragraph 2. Where the Federal Government has enacted laws, they are Supreme to state law. That means Federal regulations are Supreme as well. Many of you have heard us say in our workshops, when the school personnel are trying to run things on the basis of some local or state regulation: "Ask the school personnel where that is stated in the Federal law." It appears that the Court in this case relied solely on state law and regulations and excused behavior by the school district that clearly violated Federal law. The attorneys representing the parents raised Federal law issues but the Court basically ignored them.
