    Adopted June 13, 2000 SPONSORS: Governors Owens and Hull A. BACKGROUND 1. As Western state economies transform themselves and demand an ever-increasingly skilled workforce, it is imperative that public schools be able to respond quickly to ensure students receive an education that prepares them to succeed. Federal education programs should address the unique needs of individual states to offer an education best suited to the demands of the modern economy. 2. Federal education programs need to be more results-oriented, holding states accountable for outcomes are children safer, healthier and better educated rather than focus on process-oriented accountability. 3. States receive federal education funding through multiple funding streams that sometimes make it difficult for states to combine, redirect and target federal education funds where they will have the greatest impact on student achievement and safety. In response to concerns about federal regulations, Congress in 1999 expanded the Ed-Flex option to give all states a greater ability to apply for waivers from some federal education regulations. While a welcome step in the right direction, Ed-Flex includes only a limited number of federal education programs, and does little to reduce the bureaucratic reporting burdens faced by schools and states.

    General Statewide Regulations: The license year is March 1 through the last day of the following February.
    TROUT STAMP:
    While fishing in Nevada, any person who takes or possesses trout must carry on his person a state trout stamp affixed to his fishing license and validated by his signature in ink across the face of the stamp. The Trout Stamp fee is $10.
    EXCEPTIONS: While fishing in Nevada, youth under the age of 12, or any persons fishing under the authority of a valid short-term permit to fish or during a consecutive day validly added to that permit, are not required to obtain a trout stamp. A Trout Stamp is not required to fish on free fishing day.
    SECOND ROD STAMP:
    RESIDENT LICENSES AND PERMITS Qualifications for Resident Licenses. For the purpose of issuing and using resident licenses or permits, a person is considered to be a resident of the State of Nevada if he is a citizen of, or is lawfully entitled to remain in the United States, and during the six months preceding his application to the Division for a license or permit, he was domiciled in this state; was physically present in this state except for temporary absences; and did not purchase or apply for any resident license, tag or permit to hunt, fish or trap in another state, country or province. A resident license or permit issued by this state is void if the person to whom it was issued establishes his domicile in, and obtains any privilege or entitlement conditional on residency from another state, country or province.

    The HEM staff has been considering pulling these listings. The main reason is that as homeschooling becomes more widely accepted, and as states are scrambling to reform their education system, the situation becomes more complex. This makes overviews, listings and rankings less valid. We have, however, decided to keep these listings in place because they carry, at a minimum, a link to your state government. Additionally we hope reading cited code and at least one homeschooler's interpretation will help start to demystify legislation and encourage you to investigate further. When talking to new homeschoolers we often hear concerns about the law. Is homeschooling legal? Who do I have to notify? What do I have to teach? While the legalities are a concern that should not be ignored, neither should our response be automatic and not thought out carefully.
    There is no single source, no one true homeschooling authority. We all own the responsibility to think through laws and regulations on homeschooling. Of course you'll find those who disagree - an entire industry has grown up around the fact that there are differences of opinion on homeschooling's legal matters. What we offer here are overviews of laws and regulations compiled by knowledgeable homeschoolers. These files are not legal advice nor the final word on the subject. They are simply a starting point. To maintain our freedom to homeschool we will each need to go far beyond any convenient compilation or synopsis. We need to continue to do our own learning, lead our own research, and decide on our own actions.

Violations by students exhibiting honesty while carrying out academic assignments and procedural steps for dealing with academic integrity are delineated within the Regulations Governing Probation and Suspension Within the College of Education. This publication may be found in the Office of the Dean of the College of Education (301). In addition to successful academic performance in prescribed coursework, you are to enroll in a professional course of studies, which is governed by a student code of ethics and programmatic expectations. The Handbook of the Committee to Review Initial Licensure Students outlines the UNLV Student Code of Conduct, NEA Code of Ethics for the Teaching Profession, and ICS Student Expectations. The handbook is available in the ICS office.

    Funding for Education a Top Priority for 2003 Legislative Session The 72nd session of the Nevada State Legislature will begin February 3, 2003. The upcoming legislative session promises to be especially important for Nevada school districts, because funding for education will be one of the most prominent issues considered. At the direction of Governor Kenny Guinn, following the 2001 session of the legislature the state's 17 school district superintendents met to develop a comprehensive response to the question: What is needed to improve student achievement in Nevada? Their pursuit of an answer marks the first time in the state's history that so many in Nevada's education community have come together to define concerns and speak with near unanimity on the subject. Each county surveyed employees, identified common needs and goals and developed a statewide platform that would result in increased learning for Nevada's 370,000 K-12 students.

    3809 Can We Proceed Now?
    O n October 30, 2001 the revised 3809 regulations for surface management of hard rock mining operations on Bureau of Land Management (BLM) administered public lands were published in the Federal Register. The rules become effective December 31, 2001. This is important to Nevada's mining industry because nearly every mining operation in the state in some way requires public land and that land most often falls under the jurisdiction of the BLM. This is also important because it perhaps represents the culmination of nearly 5 years of effort to update the regulations. I say "perhaps" because a comment period on the final rules ends on December 31, 2001. And, oh yes, there has been a lawsuit filed by environmental groups, challenging Secretary of Interior Norton's issuance of these regulations. The current status of these regulations may be the most certainty the mining industry has had about the rules that it must follow for at least the last 4 years. The mining industry simply could not be sure what standards and risk of shut down it might be held to at its mining operations or exploration projects. This kind of uncertainty has stifled investment in new work on public land. In the annual survey of exploration conducted by the Nevada Division of Minerals, respondents said actual permitting time frames and an uncertain future for permitting, were among the most important factors influencing exploration investment, following favorable geology, commodity price and corporate demands.

    September Issue - The Nevada Miner
    This month’s message is excerpted from a letter from Association President Russ Fields to the Nevada Congressional delegation.
    T he Nevada mining industry has worked with the State of Nevada, the BLM, the USDA Forest Service and members of the public over the last dozen years to develop a framework of mining regulation that is second to none. The Nevada Environmental Commission adopted its water pollution control regulations for mining in the spring of 1989. Only two months later, in the summer of 1989, the legislature passed, and Governor Miller signed, the state's mined land reclamation act. These two elements of the Nevada program are protective of precious water resources and land disturbed by mining. The Nevada laws and regulations have worked well in conjunction with Federal laws and regulations governing mining. The Nevada mining industry was pleased when the National Academy of Sciences reported to Congress last year that "the overall structure of federal and state laws and regulations that provide mining-related environmental protection is complicated but generally effective." Nevertheless, the study revealed some regulatory gaps that should be addressed. The report went on to say, "Therefore, a regulatory system that is adaptive to change will serve the public, the environment and the industry best." We are in full agreement with the Academy – the best system is one with the flexibility to change as new needs are recognized. In light of that, I want to share with you some positive developments in Nevada being initiated to strengthen mining reclamation and closure bonding requirements and improve mine closure practices. The members of the Nevada Mining Association view these developments as positive for all Nevadans as well as the mining industry itself.
