Registration/Licensing/Accreditation: The approval of private schools as a substitute for public school attendance is a reasonable exercise of the state's power whereby it can be known by reasonable means that the required teaching is given. Recordkeeping/Reports: Length of School Year/Day: To comply with the compulsory attendance requirement, attendance at an approved private school must be 180 school days. N.H. Code Admin. R. Ed. 401.03. Instruction in English: Curriculum: Special Education: Health: Safety: Transportation: Home Schooling: Home schools are not considered non-public schools in New Hampshire. Home schools are considered a third type of school for attendance purposes. LETTERS TO THE EDUCATORS, NO. 5 A Constitution Is Not a Menu of Entitlements We have previously noted that an essential step in what the Supreme Court passed off in its as a string of logical propositions was its assertion the the imposition in Article 83, Part II, of the Constitution of a "duty" upon the legislators and magistrates to cherish education necessarily implied the existence of corresponding "right" in every citizen to be educated. We have also discussed how this brand of logic was rather like that of Tweedledee in Alice in Wonderland : "Contrariwise, if it was so, it might be; and, if it were so, it would be; but as it isn't, it ain't. That's logic." Even more important to the Court than its conversion of a duty into a right, however, was its characterization of the legal interests at stake as an affirmative duty and an affirmative right. The question of whether rights and duties are affirmative or negative may appear to involve nothing more than semantics, but I can assure you that it definitely has something to do with how constitutions are interpreted - and that it has everything to do with the Claremont decisions. In this regard, the Court speaks of the right "to an adequate education" rather than something like the right "to choose one's own education". In other words, the interests which the Court recognizes in its

The Promise of Charter Schools in New Hampshire: What We Know and What We Need to Do APPENDIX B Legal Steps for Establishing a Charter School Under New Hampshire Law New Hampshire's charter school law is an enabling law and is designed with one authorizer-the legislative/budgetary authority of the town or district. For all towns , the legislative authority is the voters who take action by voting on warrant articles, prepared and annotated by the school board, at annual or special district meetings. For the state's 13 cities, the legislative authority varies-for most cities the legislative authority is the board of aldermen or city council. For some cities, the legislative authority for school district matters is the voters. For Concord, the Concord school board has legislative authority. Although RSA 194-B is an enabling law, it is written so that the legislative authority must vote to enable the district to use the enabling law. This first vote is considered the "generic authorization." It allows charter school proposals to come forward for review. The second vote to ratify the charter takes place after a charter is awarded by the State Board of Education, and is referred to as the "ratification" vote. The second vote allows the charter school to be funded and to open. The question of establishing a charter school will be placed on the warrant of a special or annual school district meeting for approval. In districts without annual meetings, a public vote shall be held for the passage of an enabling warrant.
