Forest Management Forest Conservation Regulation For centuries, trees and forests have held a special value for individuals and cultures around the world. As such, it is inevitable that laws were adopted to protect and define their management. The modern debate about what we call forest practice laws began with a battle between Gifford Pinchot and William Greeley. Pinchot not only advocated public ownership of the vast federal lands, he also argued that all private forest lands should be regulated to stop the abuses of the cut and get out timber operations. Pinchot once wrote: The most urgent need of the forests of America is similar control. Voluntary cooperation as a means of ending forest devastation has broken down. Almost every civilized country has, to some extent, public control of lumbering on private forest lands. In America, we must have such controls as will stop forest devastation. This is the key to our future in forestry. Greeley believed that landowner education, technical assistance, and aid were preferable alternatives. The difference between Pinchot and Greeley reflects the classic debate between those who believe that people will do the right thing if they only know what to do and those who believe that rules must be adopted and enforced if the right thing is to be done. It is analogous to the basic rule of the road - do we really need speed limits and traffic patrols, or is driver education and a basic understanding of highway safety enough? Because we obviously need both, the question is how much of each?

Johnson Governor of New Mexico State Capitol Building Sante Fe, NM 87503 Re: Findings of Investigation of the New Mexico School for the Visually Handicapped Dear Governor Johnson: et seq . We conducted our investigation by touring the School with two consultants from April 23-26, 1997; reviewing documents; and meeting with current and former staff, students and their families, and other interested persons. Our review of documents included numerous School and State documents and individual students' records. During our tour and throughout our investigation, we received the cooperation of the staff at NMSVH. We appreciate the unimpeded access to the School that State officials afforded us. NMSVH is a residential facility, established in 1903 for the purpose of educating students with visual impairments. The census of students at the School, which once numbered two hundred or more, has dropped in recent years to between sixty-five and seventy students. The number of students in attendance fluctuates during the school year primarily as a result of expulsions and removal of students by their parents. The School educates some of its students year-round, while other students return home for the summer term. The School's summer program is open to young people who do not attend the School during the regular school year. Approximately half of the students at NMSVH have one or more disabilities in addition to their visual impairment; some of these children are nonverbal. Many of the students have behavior problems and some have significant medical needs. At least half of the students at the School are considered to be of average or above average intelligence.

Students Children should enter school ready to learn. They should be mentally, physically and emotionally prepared for learning. Students must progress through the school system on the basis of achievement of certain benchmarks. We can no longer tolerate a state statute which allows social promotions. Holding back students must be accompanied, however, by prevention and intervention programs for students at risk of leaving the system. These expectations must be the same for every student.
