Child Care and Early Childhood Education Highlights
Key child care and early education trends in state legislation include an array of financing mechanisms, basic regulatory provisions, preschool expansions and quality improvements in the form of professional development and training for providers.
Financing
State legislatures continued to expand financing for early childhood services in several ways in the past year. At least four states ( Iowa, Kentucky, New York and Texas ) enacted laws providing grants to programs. Some states ( California, Iowa, Kentucky and Texas ) expanded funding through local means. Several states ( Illinois, Montana, Nebraska and Oregon ) created tax credits for either parents or employers to support the care and development of young children. Legislatures in two states ( California and Iowa ) directed loan funds to improve child care services. Two state legislatures (

All attorneys admitted to the New York State Bar after October 1, 1997 must complete 32 hours of Mandatory Continuing Legal Education ("MCLE") within two years of admission. Newly admitted attorneys are required to take 16 hours of MCLE courses per year for each of their first two years. So-called "veteran attorneys" (those admitted more than two years) will be obligated to complete 24 hours of MCLE every biennial reporting cycle. Four of these 24 credits must be in the "ethics" category. Touro Law Center seeks to provide high quality continuing legal education programs, designed to meet the on-going needs of practicing attorneys. Touro is committed to providing practical, relevant legal education which also satisfies the MCLE requirements of New York state. Regulations Governing the Discontinuance of Water Supply and/or Sewer Service Because of Nonpayment
These regulations, authorized by Sections 1045-h(8) and 1045-j(5) of the New York Public Authorities Law, allow the New York City Department of Environmental Protection to terminate water and sewer services to customers because of nonpayment of charges imposed by the New York City Water Board. These regulations define when DEP may terminate services and the requirements DEP must follow. They also specify the procedures for customers to follow to avoid service termination by making payment of delinquent charges or entering into an installment agreement. Supreme Court Decides Golf Tour Requires "Public Accommodation"
On May 29, 2001, the Supreme Court ruled by a 7-2 vote that a golfer with a disability could ride a golfcart between shots during the Professional Golfer's Association (PGA) Tour.
The golfer, Casey Martin, had requested to use a golf cart during the tour because he has a painful circulatory disorder that makes it difficult for him to walk long distances.
The majority of the Court believed that the Americans with Disabilities Act prohibited the PGA from denying the individual equal access to its tours on the basis of his disability.
Supreme Court Limits ADA
On February 21, 2001, the United States Supreme Court ruled in University of Alabama et al. vs. Garret et al., that state employees could not recover damages by reason of a state's failure to comply with Title I of the Americans with Disabilities Act.

Introduction
This section covers the basic requirements and procedures to follow in applying for a license as a "certified social worker" in New York State. Article 154 of New York State Education Law is a title law. This means that you must be licensed to use the title "certified social worker" in New York.
General Requirements
To be licensed as a certified social worker in New York State you must:
  • be of good moral character be at least 21 years of age meet education and examination requirements
You must file an application for licensure in addition to the other forms indicated. Submit all forms, along with the appropriate fee, to the Division of Professional Licensing Services (DPLS) of the New York State Education Department. It is your responsibility to follow up with anyone you have asked to send us material. The specific requirements for licensure are contained in Article 154 opforms@mail.nysed.gov

The HEM staff has been considering pulling these listings. The main reason is that as homeschooling becomes more widely accepted, and as states are scrambling to reform their education system, the situation becomes more complex. This makes overviews, listings and rankings less valid. We have, however, decided to keep these listings in place because they carry, at a minimum, a link to your state government. Additionally we hope reading cited code and at least one homeschooler's interpretation will help start to demystify legislation and encourage you to investigate further. When talking to new homeschoolers we often hear concerns about the law. Is homeschooling legal? Who do I have to notify? What do I have to teach? While the legalities are a concern that should not be ignored, neither should our response be automatic and not thought out carefully.
There is no single source, no one true homeschooling authority. We all own the responsibility to think through laws and regulations on homeschooling. Of course you'll find those who disagree - an entire industry has grown up around the fact that there are differences of opinion on homeschooling's legal matters. What we offer here are overviews of laws and regulations compiled by knowledgeable homeschoolers. These files are not legal advice nor the final word on the subject. They are simply a starting point. To maintain our freedom to homeschool we will each need to go far beyond any convenient compilation or synopsis. We need to continue to do our own learning, lead our own research, and decide on our own actions.
