President's Message: NAAG Recognizes National Consumer Protection Week (NCPW).
February, 2003 The National Association of Attorneys General (NAAG), in conjunction with a number of other national partners, is proud to recognize February 2-8, 2003 as National Consumer Protection Week (NCPW) . The theme for this year’s NCPW is information security - an area of concern for many consumers who are fearful of losing control over their personal or sensitive information. If personal information is misused, the consequences can be devastating - an obvious invasion of privacy, serious financial losses, or even threats to an individual’s physical safety and security. In recent years, Attorneys General have been engaged in discussions with federal, state, and local officials on how law enforcement can work to better protect consumers from these unwanted intrusions or abuses. In addition, Attorneys General are working with a number of consumer advocacy groups to ensure that the public understands how to decrease their chances of being victimized This year, NAAG has joined forces with the Federal Trade Commission, the U.S. Postal Service, the U.S. Postal Inspection Service, the Federal Consumer Information Center, the National Consumers League, the American Association of Retired Persons, the Better Business Bureau, the Consumer Federation of America, and the National Association of Consumer Agency Administrators. Through our coordinated efforts, we hope to help citizens quickly recognize and report when their personal information is stolen or misued, as well as equip citizens with the essential tools to protect themselves from identity theft, Internet fraud and other crimes.

Updated September 30, 2000 ARTICLE I - DECLARATION OF RIGHTS Section 1. - All men are by nature equally free and independent and have certain inalienable rights, among which are those of enjoying and defending life and liberty; acquiring, possessing and protecting property and reputation; and pursuing and obtaining safety and happiness. Section 2. - All political power is inherent in the people. Government is instituted for the protection, security and benefit of the people, and they have a right to alter or reform the same whenever the public good may require. Section 3. - The free exercise and enjoyment of religious profession and worship, without discrimination or preference shall be forever guaranteed in this state, and no person shall be rendered incompetent to be a witness or juror on account of his opinion on matters of religious belief; but the liberty of conscience hereby secured shall not be so construed as to excuse acts of licentiousness, or justify practices inconsistent with the peace or safety of this state. School Fees "A Uniform System of Free Public Schools" Recently the ND Attorney General, Wayne Stenehjem, opined that some fees that are being charged by public schools may violate the North Dakota Constitution. The penalty can be pretty severe if schools are found in violation. They could lose their foundation aid and transportation payments. Here is what the NDDPI is saying about this issue and how complaints will be handled: School Fees PURPOSE The North Dakota Constitution requires a uniform system of free public schools throughout the state. The North Dakota Legislature has implemented that requirement through several statutes and the Attorney General has interpreted those statutes and the constitutional provision in several opinions. This document summarizes the interpretations that will be applied by this office when determining if a fee charged by a school district is permissible. The fact that a fee is permitted or not permitted reflects only the North Dakota law and is not a policy decision which can be changed by this office. Under North Dakota laws, fees are allowed for the following:

District(s): At Large The Dakota Carrier Network will use RUS funds to complete Phase 2 of the North Dakota State network which will make it possible to install network equipment in K -12 schools and libraries across the State. The vast country serviced by DCN includes over 63,000 square miles which translates to 90 percent of the total area of the State. The company currently services over 164,000 customers in 244 communities. The infrastructure to be built with these loan and grant funds includes the installation of additional ATM backbone switches to handle the load created by the addition of the schools and libraries. DCN intends to provide service that will benefit 207 schools and 26 libraries across the State.

(SACRAMENTO) – Attorney General Bill Lockyer announced today that five of the largest U.S. distributors of music CDs and three national chain stores have agreed to pay $67.4 million for consumer refunds and provide some seven million free music CDs valued at $75.7 million for schools, libraries and charities to settle a multi-state price-fixing complaint.
The free music CDs are going to public schools and libraries. Partial refund payments will be mailed to consumers who submit valid claims to a court-appointed claims administrator. Details of the refund program will be announced later, once the court approves the settlement. Contrary to some news media reports appearing on this settlement, there are no free CDs being given to consumers at the retail stores.
"Our antitrust investigation found illegal sales agreements being used to stifle competition and fix the prices of music CDs," Lockyer said. "Instead of benefitting from a competitive marketplace, consumers looking for music entertainment had their pocketbooks squeezed by these secret deals to artificially inflate prices."

Back to Home Thursday, Apr 10, 2003 News Posted on Thu, Jan. 30, 2003 NORTH DAKOTA LEGISLATURE: Lottery critics seek tougher rules Associated Press BISMARCK Opponents of a North Dakota lottery asked Wednesday for tough limits on the game, including advertising restrictions and a minimum age of 21 to buy or sell tickets. "Lottery tickets, like cigarettes and whiskey, must be kept away from children," Andrew Varvel of Bismarck told the House Judiciary Committee on Wednesday. "The most effective way to do that is to limit sales to merchants with experience in keeping children away." The committee Wednesday began its job of reviewing legislation, introduced by Rep. Andy Maragos, R-Minot, that would establish a regulatory framework for the lottery's operations. Maragos led a successful initiative campaign last fall to persuade North Dakota voters to endorse the state's entry into a multistate lottery. Maragos and other lawmakers expect the state will take part in the Powerball game, which is already offered in Minnesota, South Dakota and Montana. He was exasperated Wednesday by critics' suggestions that a lottery player should be at least 21 years old. All of North Dakota's border states consider someone who is 18 years old to be mature enough to play, and a 21 age limit would cause buyers to go to a neighboring state, Maragos said.

GENERAL INFORMATION WICHE's Professional Student Exchange Program enables students in 13 western states to enroll in out-of- state professional programs when those fields of study are not available at public institutions in their home states. Exchange students receive preference in admissions. They pay reduced levels of tuition: for most students, resident tuition in public institutions and approximately one-third the standard tuition at private schools. The home state pays a support fee to the admitting schools to help cover the cost of students' education for the " normal" length of the program.
