Civil Liberties Groups Say New Encryption Export Regulations Still Have Serious Constitutional Deficiencies
Washington, DC Leading Internet civil liberties groups said today that new encryption export regulations released by the U.S. Commerce Department fall short of the Clinton Administration's promise to deregulate the privacy-enhancing technology. The American Civil Liberties Union (ACLU), Electronic Frontier Foundation (EFF) and Electronic Privacy Information Center (EPIC) will continue to press their Constitutional cases. These court cases seek to eliminate U.S. government regulations that make Internet encryption software and technology more cumbersome to publish or send than the same items when published in other media. While the Administration has taken a step in the right direction with its latest revisions, the fundamental constitutional defects of the encryption export regime have not been remedied. Specifically:
  • The new regulations, like the old ones, impose special requirements on Internet speech, contrary to the Supreme Court's 1997 ruling in Reno v. ACLU. The regulations require that the government be notified of any electronic "export" of publicly available encryption source code, and prohibit electronic "export" to certain countries. Yet people may freely send the same information anywhere on paper.
  • The export regulations are still a completely discretionary licensing scheme. They continue to require licenses for a large amount of communication protected by the First Amendment, including transmitting source code that is not "publicly available," source code that is "restricted," source code forming an "open cryptographic interface," and various forms of object code.

Email: chronicle@chronohio.com By Eric Resnick Columbus— As the Ohio Supreme Court heard oral arguments on the state’s importuning law February 5, it appeared that both sides agreed on many points. The 30-year-old law makes it a crime to proposition someone of the same sex if it would offend them. It does not apply to heterosexual situations. The statute is often used for police stings in parks, where gay men are charged for asking an undercover officer if they are interested in sex. This case arose when Eric R. Thompson of Ashtabula leaned out his car window in 1999 and asked a male jogger if he wanted oral sex. The jogger said to leave him alone, and Thompson complied. But the jogger complained to police, and Thompson was arrested and convicted of importuning. He spent six months in jail, the maximum time allowed. With help of Ashtabula County public defender Marie Lane, Thompson appealed the conviction on constitutional grounds, saying the law violates the equal-protection clauses of both the Ohio and United States constitutions.

Ashbrook , July/August) 06/07/01, The ACLU decided today NOT to appeal to the US Supreme Court, the 6th District ruling that said Ohio's state motto "With God All Things Are Possible" is constitutional. See item below. 03/00, Voting 9-4, the full 6th U.S. Circuit Court of Appeals ruled that Ohio's motto, ``With God, all things are possible,'' is constitutional and is not an endorsement of Christianity even though it quotes the words of Jesus. The case went to the full appeals court after three 6th Circuit judges ruled last April that the motto violated the U.S. Constitution as a government endorsement of religion. The full court's decision reverses the three-judge panel's decision. The ACLU can now ask the U.S. Supreme Court to review the case. Chris Link, executive director of the Ohio ACLU chapter, said its lawyers first must discuss whether they think the high court will consider the case worth accepting for argument. The ACLU represented the Rev. Matthew Peterson, a Presbyterian minister in suburban Cleveland who objected to Ohio's motto. (Associated Press)
