THE JOINT LEGISLATIVE ETHICS COMMITTEE Advisory Opinion 95-012 September 27, 1995 Syllabus by the Committee: First, you have asked whether a member of the General Assembly may maintain a full general partnership in an Ohio law firm which bears his name in its title. There are no provisions contained in Chapter 102., or otherwise, prohibiting a member from using his name in the title of his law firm. The only such prohibition that exists pertains to elected judges. Next, you have asked if a member of the General Assembly, or the member's law partners, can represent county, local city and exempted village, and JVS school districts; villages, cities, townships, counties, libraries, library districts, joint fire and/or ambulance districts. Initially, it must be noted nothing in the Ethics Law is applicable to the work performed by the partners in your law firm; the prohibitions, if any, are applicable only to you, as a member of the General Assembly. A member of the General Assembly is not prohibited from representing local entities such as those listed above. Lastly, you have asked if you can perform services such as rendering legal opinions, representing clients in court or other proceedings, or being involved in labor negotiations. These issues have recently been addressed in JLEC Advisory Opinion No. 95-006. The Committee directs your attention to that opinion since you are "similarly situated" and the opinion provides equal immunity to you. See R.C. 102.08. Background
The U.S. Environmental Protection Agency has been conducting reviews of several Ohio programs in response to a petition submitted on behalf of Ohio Citizen Action, the Ohio Environmental Council (later replaced by PIRG in the Petition), the Sierra Club, and Rivers Unlimited. EPA received a petition asking it to withdraw and/or revoke a number of environmental programs in Ohio based on 1) the Ohio audit law and 2) Ohio Environmental Protection Agency's implementation of programs. In early 1997, Attorney D. David Altman submitted a petition and amendment on behalf of the environmental groups requesting that EPA withdraw and/or revoke Ohio's Resource Conservation and Recovery Act hazardous waste program, Clean Air Act Title V program and Clean Water Act National Pollutant Discharge Elimination System program based on the Ohio Audit Privilege and Immunity Law. Mr. Altman further supplemented and/or amended the petition on September 18, 1998; August 4, 1999; and January 27, 2000, to reiterate his concerns with the audit law and its amendments and to add allegations regarding how OEPA was implementing these programs. The January 27, 2000, supplement also expanded the petition to cover additional programs.

August 29, 2001 OHIO ENERGY COMPANY FINED, ORDERED TO PAY RESTITUTION Hundreds of New Yorkers Victims of Shoddy Service and Contract Violations
Attorney General Eliot Spitzer today announced that an Ohio-based energy company will pay nearly $235,000 in penalties, restitution and account credits to 300 of its New York customers for engaging in deceptive practices and providing poor customer service.
Today’s announcement marks the second punitive action against Level Propane Gases, Inc., of Westlake, Ohio, taken by Attorney General Spitzer in the last 18 months.
"Time and again this company violated state laws and betrayed the trust of hard-working New York consumers who chose to do business with it," said Attorney General Spitzer. "New York is a lucrative market for both in-state and out-of-state businesses. However, we will not tolerate fraudulent or deceptive practices in the conduct of business in this state."
Today, Attorney General Spitzer announced that Level Propane will pay $77,858 in restitution and $57,038 in account credits to 300 New York customers and pay $100,000 in penalties and costs to the state.

H. Counties
Counties are the major political subdivision of the state, for two reasons. First, counties are pervasive - every bit of territory within Ohio is in a county, and all residents of Ohio live in a county. Second, counties administer such important state-required functions as systems of justice, human services, land recording, property taxes and elections. Counties possess police power, which gives them authority to regulate land use, sanitation, building construction, etc. Many of the functions of county government are mandated by state government. In most instances, the level of mandated service is determined by the local county. For instance, a sheriff's department is mandated, but the intensity of patrolling is at the discretion of the county. Counties may choose one of three forms of government: the general statutory law, the alternative statutory law or charter. The alternative and charter forms must be adopted by the voters. Under the general form, there are many elected executive officers, and no chief executive officer. Counties under this form do not possess legislative authority - that is, they cannot adopt ordinances or law. They may perform only those acts and duties as prescribed by the

T he Ohio Attorney General has adopted very tough and specific rules on advertising by auto dealers. These rules are designed to protect the consumer by forcing the dealer to avoid certain tactics perceived to be unfair. Compliance many times involves requirements to provide certain information to the consumer by the auto dealer that is believed to be essential for the consumer to make an informed decision. Many times, the information the dealer must provide in an advertisement is even regulated as to the size of the print that must be used
