The most disconcerting fact of the study was that the students in the public schools and those in the private schools were dissimilar ìespecially on the parent education level, one of the most significant out-of-school influences on achievement research has ever foundî (Saks 27). According to the American Federation of Teachers, if the studentsí mothersí education is allowed for in the study, the advantage of the students in the MPCP becomes nonexistent (Saks 27). In truth, the study has not proved the MPCP to be a successful program.

Special to free! Printer-friendly page The case of Mitchell v. Helms, which the Supreme Court agreed yesterday to review next fall, has an Internet flair to it. But in most respects, it resembles many of the battles over "parochaid" that the Supreme Court has struggled with over the last several decades. It tests whether a longstanding federal program that allows local public school districts to loan classroom equipment, including computers, to parochial and other private schools, violates the First Amendment's prohibition against government establishment of religion. The 5th U.S. Circuit Court of Appeals struck down the program, asserting that because of the establishment clause, "what the government is attempting to accomplish … it may not do." In 1968, in Board of Education v. Allen, the court had upheld a program that lent textbooks to parochial schools. But in two subsequent rulings, which were invoked by the 5th Circuit in its ruling, the high court struck down programs that lent other kinds of instructional materials to parochial schools, drawing a line that was difficult to define. Those precedents and others have produced what the 5th Circuit panel described as a "vast, perplexing desert of establishment clause jurisprudence" that the Supreme Court will, if it can, clean up.

Before the end of June, the Supreme Court will decide a widely anticipated First Amendment case, Mitchell vs. Helms, which will clarify the limits on public aid to parochial schools. This topic has triggered epic battles in courtrooms and legislative chambers for some 75 years, and, with such hot issues as the constitutionality of school vouchers still in the air, these fights show no sign of easing. The case also has implications for the $13.5 billion Elementary and Secondary Education Act (ESEA) that Congress is presently reauthorizing and which funds innumerable programs that benefit students in private, frequently religious, schools, as well as public school students. The specific issue in Mitchell is whether federal Chapter 2 funds (which are now included within Title VI of the ESEA) can be used by parochial schools in Jefferson Parish, La., to purchase computers, software and library books. Schools generally use these funds to buy technology and instructional materials, including library resources and software, to support programs for at-risk and gifted students and for miscellaneous school improvements. By law, private school students are eligible to participate equitably in obtaining "secular, neutral, and non-ideological services, materials, and equipment."

School-choice enthusiasts, take cautious heart. You have four firm friends on the Supreme Court and another two justices who signaled yesterday that they just might uphold state-supplied vouchers when put to the test. How long that situation will last, however, is quite another question.
By a 6-3 margin, the court ruled in Mitchell v. Helms that the First Amendment allows religious schools to use federal education dollars for computers, software, library books and other instructional materials. In doing so, it overturned two restrictive school-aid cases from the 1970s.
Joined by three colleagues, Justice Clarence Thomas issued a sweeping opinion holding that government aid offered to schools or students without regard to their religion and based on neutral, secular criteria does not have the effect of advancing religion, and hence does not collide with the First Amendment's prohibition against government establishment of religion. A narrower opinion by Justice Sandra Day O'Connor, joined by Justice Stephen Breyer, provided the other two votes in this intricate decision. The upshot: Federal education aid can continue to be used to enhance the schooling of all American children, no matter what sort of school they attend.
The Mitchell case goes back to 1985, when Mary Helms and other taxpayers in Jefferson Parish, La., filed suit against federal, state and local education authorities, asserting that the federal program then known as Chapter 2 violated the First Amendment because some of its funds flowed to parochial school students. Guy and Jan Mitchell, parents of Catholic-school pupils eligible for Chapter 2 benefits, intervened to defend the program's constitutionality.

On June 28, as this report was going to press, the United States Supreme Court decided an important and long-awaited First Amendment case clarifying the extent to which public dollars can assist students in parochial schools. This topic has triggered epic battles in courtrooms and legislative chambers for some seventy-five years, and, with such hot issues as the constitutionality of school vouchers much with us today, the arguments show no sign of abating. By a 6-3 margin, the Court ruled in Mitchell v. Helms The Mitchell Mitchell Thus the policy terrain on which Mitchell has landed is bumpy and uneven as one moves from place to place. We do not, however, expect the policy debate to end anytime soon. It may even intensify. The expected retirement of three and perhaps four Supreme Court justices during the next presidential administration also means that the direction of the Court in these (and other) contentious cases could dramatically shift. Much is unsettled.

, December 12, 2000 A federal appeals court declared a Cleveland school voucher program unconstitutional yesterday, upholding a lower court ruling that the use of public money to send thousands of children to parochial schools breaches the First Amendment's separation of church and state. The 2-to-1 decision, which included a vitriolic exchange among the judges, sets the stage for a United States Supreme Court showdown on one of the most contentious issues in education politics today. It comes a month after voters in Michigan and California roundly rejected school voucher programs in ballot initiatives and is the most significant legal decision yet on the question. "We certainly hope everyone will get the message," said Robert H. Chanin, general counsel for the National Education Association, the nation's largest teacher's union, who argued the case for a group of parents and teachers challenging the vouchers. "The message is, let's focus on improving the public schools and stop playing around with vouchers as a panacea." In the ruling, Judge Eric L. Clay of the United States Court of Appeals for the Sixth Circuit said the Cleveland program did not present parents with a real set of options, because few nonreligious private schools and no suburban public schools had opened their doors. In 1999-2000, 96 percent of the 3,761 voucher students attended sectarian schools, receiving up to $2,500 each to offset tuition....

The program has historically provided grants to help schools implement interactive video distance learning and Internet technologies that link students with other schools, institutions of higher education, fine arts institutions, libraries, zoos and other educational service providers. It is the Ohio SchoolNet Telecommunity vision:
  • To create a statewide system so that all Ohio students, regardless of school, geographic location and socioeconomic background, have access to high-quality, concept-driven learning experiences. This statewide system is intended to support and extend the overall state’s vision of systemic reform in education.
Through the first five years of the program, the Ohio SchoolNet Telecommunity has provided more than $26 million to over 385 Ohio school districts in support of its statewide video connectivity mission. Forty Implementation Grant projects have been launched, enabling over 500 K-12 schools and 75 content and professional development partner entities to acquire video distance learning equipment. In addition, 150 grants of up to $8,000 each have been awarded to non-public schools and community schools for the implementation of Internet projects. Grant opportunities are usually offered twice each year. The Ohio SchoolNet Telecommunity is expected to distribute more than $32 million to Ohio schools, content providers and other educational entities over the life of the program.
