Peck, Legislative Counsel DATE: January 22, 1992 RE: Private School Choice Demonstration Amendment The proposed school choice demonstration amendment to S. 2 would permit states to include private and parochial schools as "choice schools," notwithstanding contrary provisions of state law. While this effectively preempts state law after the Secretary of Education awards grants for the demonstration projects, it does not and cannot do so before an award is made. Therefore, a number of states, operating under state constitutions that prohibit the public funding of sectarian schools or institutions, are ineligible to apply for the grants. A government has only the power and authority granted to it by the people through a constitution. This is the foundation of a nation that observes "the rule of law." Just as the authority of the federal government is limited by the powers granted and denied by the federal Constitution, the authority of the state governments are limited by the powers granted and denied by their respective state constitutions. Where a state constitution prohibits public funding of sectarian institutions, the state would violate its constitution when it applied for the grant program contemplated by the choice demonstration amendment because it would exceed its constitutional authority. Thus, the following states are constitutionally inhibited from participating in the choice demonstration and cannot benefit from the amendment under consideration:

Montaigne Defaming public education has become a national sport for a handful of cranks whose agendas range from closing public schools to tapping the money for personal gain. The critics can't be confronted unless their motives are known. They generally fall into three categories: First, the hierarchy of the Catholic Church wants taxpayers to fund parochial schools. Period. According to Dr. Henry Levin's pioneering study at Stanford, that would suck $33 billion out of public school funds the first year. Second is the religious right, a polyglot group of religious fanatics who swear public schools are teaching a religion called secular humanism. They want to fund home schooling and "Christian" schools with public school dollars although public education already is the ninth most poorly funded among the industrial nations of the world. Daily Oklahoman Public education is far from perfect, but the virulent propaganda being used to defame it by this venomous crew is beneath contempt. America Says No To Vouchers By Frosty Troy Most Americans love and support public education, a fact that is driving rightwingers to despair. From Education Secretary Rod Paige and William Bennett to Rush Limbaugh and "Doctor" Laura, a new Gallup Poll knocks down their false, relentless, malicious attack on public schools and public educators. Americans give record high grades to the public schools, and they don't want tax money used to underwrite private and parochial schools. These are among the major findings in the 33rd Phi Delta Kappa/Gallup Poll of the Public's Attitudes Toward the Public Schools. The schools have an all-time high public approval rating. The 51% assigning an A or B to schools marks the first time a majority of the public has given grades this high. The 51% is an increase of 11% since 1990 and is a fitting close to a decade in which public school approval ratings climbed steadily despite what might reasonably be described as less than favorable media coverage. Support among parents who have children in public schools jumped even higher, with 68% giving As and Bs to schools attended by their oldest child. Support for the use of public funds for parents and students to use in attending private and church-related schools is only 34%. Some polls have it as low as 22%.

Gov. Frank Keating (R-Okla.) F rank Keating was born on February 10, 1944, in St. Louis and moved to Tulsa with his family when he was six months old. He was educated there in parochial schools, attending Marquette and Monte Cassino elementary schools and graduating from Cascia Hall High School. He received his undergraduate degree in history from Georgetown University and returned to Oklahoma to earn his law degree at the University of Oklahoma in 1969. He has received honorary degrees from Seton Hall University in New Jersey and Grove City College and LaRoche College in Pittsburgh. After service as an FBI agent, Keating was a local prosecutor in Tulsa. He later served in both houses of the Oklahoma Legislature, rising to minority leader of the State Senate, and was named U. S. Attorney for the Northern District of Oklahoma in 1981. From 1985 through 1993 he served in Washington as Assistant Secretary of the Treasury, Associate Attorney General and as General Counsel at the Department of Housing and Urban Development. In those roles, Keating had oversight responsibility for virtually every federal law enforcement agency. Governor Keating is a lifelong Catholic communicant. In 1980 he received a papal appointment as a Knight of the Holy Sepulchre. He and his family attend St. Joseph's Old Cathedral and Corpus Christi churches in Oklahoma City.

Other state institutions are three normal schools, located at Edmond, Alva, and Weatherford; the Agricultural and Mechanical College at Stillwater; the university preparatory school at Tonkawa; a school for the deaf at Sulpher; an institute for the blind at Wagoner; the Whitaker Orphans' Home in Pryor Creek; five district agricultural schools, one in each judicial district of the state. OUR SCHOOLS Article from Our City, North Little Rock, Arkansas, Complied by North Little Rock Chamber of Commerce, 1957. We have no doubt that the family who has children of school age will be definitely interested in this important subject. In order to open a gate to information we would like to start with the physical property and perhaps talk about administration and other facts which should be of interest to you. We have two systems of schools here, the public schools and the parochial schools. The public school system has 19 elementary and junior and senior high schools with an enrollment of more than 9,000 pupils. The parochial schools have three elementary schools with an enrollment of more than 500 students. In North Little Rock we practice segregation of white and colored, however, the schools or' both groups build identical buildings for each and the teachers are paid the same rate of salary based on experience and educational background. If we should try today to rebuild all of our present schools it would cost in the neighborhood of 10 million dollars. We are building additions and new school buildings in each of our fast growing areas in order to care for the increased population which we are now enjoying and which we anticipate for the future. Since 1925 our schools are fully accredited by the North Central Association for colleges and secondary schools. We have one institution of higher learning, which is Shorter College for colored, with junior college rating with an enrollment of more than 300 students. This school is under the direction of the AME Convention of Arkansas and Oklahoma.
