The use of leisure time has become an ever greater focus of attention,as a result of higher incomes,expanding leisure time and a growing interest in nature. The trend is reflected in the increasing popularity of sports and recreational activities in the prefecture. Fukushima's abundant nature,combined with extensive leisure facilities,attracts sports and leisure-minded youth and adults,from both inside and outside the prefecture year-round. There are three national parks and eleven prefectural natural parks in Fukushima,providing excellent opportunities for sports and leisure activities that cannot be enjoyed in urban areas. The relevant bodies are required to take such steps as are reasonably practicable and consistent with other enactments relating to their functions, to secure that any rights which they have to the use of water and associated land are exercised so as to ensure that the water or land is made available, in the best manner, for recreational purposes. Opportunities are particularly likely to arise in respect of:
  • inland reservoirs, flooded gravel pits and coastal waters, which may be an important resource for active water sports, such as sailing and windsurfing, and for angling, walking and birdwatching upland water gathering grounds, where there should be provision for informal recreation such as walking, mountaineering and quiet enjoyment of the countryside. Wherever possible, access on roads and tracks should be extended to horse riders and cyclists for informal recreation. Access for organised activities such as orienteering, paragliding and caving should be granted unless there are clear reasons why it should be refused.

Byelaws may be made regulating public behaviour there generally, including the placing of temporary structures or vehicles, the playing of games, riding, driving, selling and hawking. Special restrictions may be justified if the seashore is a public pleasure ground: Gray v Sylvester (1897) 61 Justice of the Peace 807. But a byelaw will be invalid if it is unreasonable: Parker v Bournemouth Corporation (1902) 86 Law Times 449; or if it is not made "for the prevention of danger, obstruction or annoyance to persons using the seashore": Moorman v Tordoff (1908) 98 Law Times 416.

Access Issues
Currently, almost 1 in 5 crags in the Sydney region are affected by access issues of one sort or another. The following excerpts are from the relevant NPWS and Council documents. NSW National Parks and Wildlife Service National Parks and Wildlife Regulation
Clause 19, Section 21

Page 29: "(1) A person must not in a park:
(d) engage in any activity or recreational pursuit that involves risking the safety of the person or the safety of other persons or damaging the environment.
(2) Without limiting the generality of subclause (1) (d), the activities and recreational pursuits to which that paragraph applies include abseiling, base jumping, bungy jumping, rock climbing, caving, parachuting, white water boating, paragliding, parasailing and hang gliding, but the paragraph will not apply if the activity is permitted in a plan of management for the park."

In other words, climbing without explicit permission from NPWS is not allowed in any National Park in NSW, unless the Park's Plan of Management makes an exception. Parks which currently meet this criteria include Blue Mountains, Kanangra-Boyd, Wollemi and Ku-ring-gai Chase (Barrenjoey only) National Parks.

Forest Plan Update
Fellow So Cal pilots, The National Forest Service in Southern California is in the lengthy process of updating the "Forest Plan". The four Forests from Big Sur to San Diego; the Los Padres, Angeles, San Bernardino and Cleveland National Forests are updating their plan simultaneously. The FS planers are asking for input from Forest users during this long process, and with a majority of our flying sites on FS lands, this is a great opportunity for us to strengthen our relationship with the FS and get our sport "written in" as one of the appropriate recreational activities. The plan is a broad scale policy guideline that the FS uses as a tool for management direction and rule making. All of the different forests as well as the individual districts within the forest have the independent authority to, on a site by site basis, support or restrict any activity if the local supervisor or ranger thinks the activity is beneficial or harmful to the forest.
