The Parental Rights and Responsibilities Act of 1995: A Brief Legal Analysis This Memorandum discusses the current status of parents' rights against government interference with the care of children, the need for further legal protection of those rights, the con- stitutional authority of Congress to adopt laws for that purpose, and the legal effects of the proposed Parental Rights and Respon- sibilities Act of 1995, H.R. 1946 ("PRRA" or the "Act"). The Memorandum is brief and not a thorough discussion. The Memorandum concludes that, because of ambiguities in the case law, parents frequently cannot resist undue government interference with the raising of their children, that Congress has a constitutional duty to consider and authority to enact legislation to protect parental rights, and that the PRRA is a desirable bill to accomplish this goal. Opponents of legislation predict a "bonanza" for lawyers

Two bills currently making their way through Congress could have monumental consequences for school counselors and a host of other helping professionals. The bills in the U.S. House of Representatives (H.R. 1946) and the U.S. Senate (S. 984) are both commonly referred to as the "Parental Rights and Responsibilities Act" (PRRA).
Supporters of PRRA claim that all too often schools and courts impinge on the rights of parents to make parenting decisions. Rep. Steve Largent (R-Okla.), who introduced PRRA in the House, told the House Constitution Subcommittee of the Judiciary Committee that "the Parental Rights and Responsibilities Act is a simple bill, yet it has profound implications in terms of how the government treats and respects families and specifically parents." The first-term representative and former professional football star ran on a conservative platform in 1994 and told a prayer breakfast during his campaign that opponents of the religious right were "the enemy." He went on to tell the committee that "[t]he founding fathers came to this new country to be free and to escape the burdensome obligations of a government that did not respect them or how they chose to live."
Michael P. Farris, president of the Home School Legal Defense Association, told the Senate Subcommittee on Administrative Oversight and the Courts that PRRA embraces the notion that the rights of parents to direct the upbringing of their children is one of the most important principles of constitutional liberty and should be on the same level as freedom of speech, freedom of the press, freedom of assembly, and the free exercise of religion.

What do Arizona, Connecticut, Tennessee and Kentucky have in common? They’re states where potentially bad home schools have been introduced in this legislative session. For the first four to five months of every year beginning in January, the HSLDA lawyers and their legal assistants are involved in an intense struggle to protect the freedoms that home schoolers have gained for these last 20 years. It seems like home schoolers have done well enough over the years to be left alone. But unfortunately, that is not the case.
Despite the fact that home schoolers on the average score 20-30 percentile points above the norm, there are those that want to put more regulation on home schoolers. Typically, these folks come from the education establishment, i.e., principals, superintendents, truant officers and lobbyists from teachers’ unions. Many of them do not have a very high view of home education.

The Quiet War Against America's Independence Bush Judicial Appointees Should Be Pro-Parent

When President George W. Bush gets around to appointing federal judges, the issue of parental rights should be a major criterion. One model for what this means is contained in the principles recently outlined by the Wyoming Supreme Court. In two recent cases, the Wyoming Supreme Court was presented with the state's demand to dictate medical treatment for children despite parental objections. The Wyoming Department of Health had insisted that children receive the controversial hepatitis B vaccine as a condition of entering public school, even though there is no hepatitis B problem in the Wyoming schools. This government busybody approach is chapter and verse from Hillary Clinton's ideology that the village should raise children, complete with village-mandated health requirements. Regrettably, many public-health and public-school personnel have bought into this vision of government-family relations. Hepatitis B is a disease transmitted via bodily fluids like AIDS, such as from promiscuous sex and needle exchanges, and is not ordinarily contagious in school. Isn't it strange that schools are trying to force this vaccine, despite its side effects, on children but not on teachers? Perhaps because parents are not as well organized as teachers?

Portions of these articles are reprinted with the permission from the November 29, 1999, issue of Texas Education News TJF Expands its Focus The Texas Justice Foundation (TJF), a nonprofit, public interest litigation group, is now offering school board members the chance to earn required board training credit and is helping to establish "Parental Rights Councils" in local districts. TJF's first school board member training session on November 11 in San Antonio featured Betty Ressel, manager of the state comptroller's Texas School Performance Review; Charles Untermeyer; SBOE chair, a pair of attorneys who are leading the pro-prayer legal battle; and the president of the Texas Conservative Coalition. The next school board training sessions are scheduled for February 4 in Austin, March 3 in Dallas, and April 7 in Houston.

Answer: EVERYTHING! The policy was instituted because of parental rights, and there are strong reasons why it should be revoked because of parental rights. In fact, all public school disciplinary policies are, or at least should be, crafted to achieve a balance between seemingly-opposing "rights." This is no different whatsoever from the situation that exists in society as a whole, as expressed in the old saying that the right of free speech doesn't mean you can yell "fire" in a crowded theater. To say it another way, "your freedom to swing your arms ends where my nose begins!" Rights are not absolute - they inevitably involve tradeoffs. Public schools generally recognize this and attempt to achieve a reasonable balance in their policies.

Today we are marking up the English Language Fluency Act, landmark legislation that should help improve the ability of English language learners to succeed in school and in life. Consideration of this legislation comes at a time when individuals throughout the United States are expressing concern about the failure of bilingual education programs, in general, to teach English to English language learners as quickly as possible. As you probably know, my own State of California, by a margin of 61 percent to 39 percent, voted to end bilingual education programs and to focus on teaching children English. During my years in Congress, I have heard many individuals, including parents, raise concerns about the current Bilingual Education Act and the fact that many children spend as many as six or seven years in classes using their native language in instruction, but still are not fluent in English. In addition, the U. S. Commission on Civil Rights, in their November, 1997 report states that "one aspect of Federal legislation over the past three decades has had adverse effects on schools’ development and implementation of education programs with a primary goal of placing students in regular education program to the greatest extent possible. This has been the emphasis on provisions that restrict the options schools may pursue in developing and implementing education programs. The Bilingual Education Act has placed restrictions on the types of programs that could be funded under the act, and these restrictions have, in turn, limited school districts’ options." The report goes on to say that, "in some cases, the emphasis on bilingual education resulted in limited English proficient students being unnecessarily segregated from their English-proficient peers, even after they were able to participate meaningfully in the regular classroom."

Although Brazilian children are receiving a good education at home by their parents, this method of instruction has still not received official recognition by the government. In fact, the Council of Education has recently condemned home schooling in the Vilhena case. This is a travesty for a free nation like Brazil to deny parents the fundamental human right to direct the education and upbringing of their children. Carlos Vilhena family has been home schooling with great success for several years. By PAT SCALES According to statistics gathered by the ALA Office for Intellectual Freedom and the National Coalition against Censorship, book challenges are at an epidemic level in school and public libraries across the United States. What is amiss in this "land of the free"? Is this "censorship war" about fear? control? power? How does this battle affect the education of our children? What kind of messages are we sending to them regarding their constitutional rights? When I was in library school, there was a course called "Censorship." This course surveyed books such as Portnoy's Complaint Of Mice and Men , and The Catcher in the Rye . This was in the days before Judy Blume, Robert Cormier, Stephen King, R.L. Stein, Katherine Paterson, and Alvin Schwartz. It was in the days when public libraries had more challenges than school libraries. Most library school students took this censorship course for personal enjoyment. They never realized that fighting censorship could become a very real part of their job. Today, the battle is raging, and public librarians and school media specialists are stumbling in their fight to win the war. The enemies are organized groups of people, from the right and the left, who are determined to gain power over what students read and learn.
