[March 25, 1998] Justice Stevens, concurring in part and dissenting in part. Fourteenth Amendment never I Meachum v. Fano 427 U.S. 215 Bishop v. Wood, 426 U.S. 341 (1976). There is, however, no room for legitimate debate about whether a living person has a constitutionally protected interest in life. He obviously does. Nor does Connecticut Bd. of Pardons v. Dumschat, 452 U.S. 458 Id., Greenholtz v. Inmates of Neb. Penal and Correctional Complex, 442 U.S. 1 II There are valid reasons for concluding that even if due process is required in clemency proceedings, only the most basic elements of fair procedure are required. Presumably a State might eliminate this aspect of capital sentencing entirely, and it unquestionably may allow the executive virtually unfettered discretion in determining the merits of appeals for mercy. Nevertheless, there are equally valid reasons for concluding that these proceedings are not entirely exempt from judicial review. I think, for example, that no one would contend that a governor could ignore the commands of the Equal Protection Clause and use race, religion, or political affiliation as a standard for granting or denying clemency. Our cases also support the conclusion that if a State adopts a clemency procedure as an integral part of its system for finally determining whether to deprive a person of life, that procedure must comport with the Due Process Clause.

About The mission of Lane County Community Corrections, Adult Parole and Probation is to protect the community, including victims, by reducing criminal recidivism through reformative programs, offender supervision and a continuum of sanctions. The program purpose of Community Corrections is the provision of supervision and support services to probationers and parolees residing in Lane County, to conduct investigations at the request of other counties/states for supervision transfers, to prepare pre-sentence investigations and to complete release plans for offenders returning to Lane County or soon to be released from prison. Two parole/probation officers team up with a mental health specialist and a community service worker to deliver offender-specific anger management programming, pre-treatment/life-skills training and a motivational/life-planning curriculum using the Framework for Recovery format. Refreshments will be served. "We set up our parole and probation office in Creswell last November to expand our supervision efforts," said Steve Lauch, adult parole and probation manager. "By decentralizing, we’re better meeting the needs of neighboring rural communities." The South Lane County Team supervises more than 200 offenders that are supervised for convictions of crimes against people, drug crimes, property crimes, domestic violence and sex offenses. Lauch said his agency is trying to locate an office for its East Lane County Team, which serves Springfield and Highway 126 East to McKenzie Bridge and Marcola Road east to Marcola. He said two officers are assigned to the Interagency Narcotics Enforcement Team, known as INET; one officer assigned to gangs; one officer assigned to a HUD Housing Project in Springfield; and three officers working at both the Whiteaker and University Community Policing stations. Reinventing Parole and Probation
A lock-'m-up hardliner makes the case for probation by John J. DiIulio, Jr. No oneat least no one in elite policy-wonk circles is a bigger fan of incarcerating known, adjudicated adult and juvenile criminals than I am. No one has written more over the years about the cost-effectiveness of incarceration as measured both in terms of its crime-reduction value and in terms of doing justice. Still, when it comes to the search for rational, workable crime policies, it's time to admit that the brain-dead law-and-order right is no better than the soft-in-the-head anti-incarceration left. More and more conservatives now favor abolishing parole, sharply curtailing probation, imprisoning every adult felon for his or her entire term, and warehousing juvenile offenders in adult jails. The prudent response, however, is not to abolish probation and parole, but to reinvent them. First, let's get crystal clear on the grim facts about crime, prisons, probation, and parole. Be giddy about recent drops in national crime rates if you wish, but each year Americans still suffer some 40 million criminal victimizations; about a quarter of these are violent crimes. Only about 1 in 100 crimes actually results in anyone getting caught, convicted, and sentenced to prison. Most felony defendants are repeat offenders; yet most felony defendants are sentenced not to prison but to probation. Likewise, a half-dozen studies prove beyond a reasonable doubt what every veteran policeman knows: most prisoners are not petty, nonviolent thieves or mere first-time, low-level drug offenders. Yet most of these hardened criminals are still paroled well before they have served out their latest sentence behind bars. On any given day in America, there are three convicted adult criminals out on probation or parole for every one in prisonand many of these are indistinguishable (in terms of their violent and repeat criminal histories) from those who remain in prison. As for juvenile offenders, between 1989 and 1993 the number of adjudicated juvenile cases that resulted in probation rose by 17 percent. The number of probation cases involving a "person offense"such as homicide, rape, robbery, or assaultsoared by 45 percent.
