Jakcsy, Ph.D. "Either before or not later than 10 business days after either first removing the child for more than 10 school days in a school year or commencing a removal that constitutes a change of placement under Sec. 300.519...including (a)(2) of this section" (a 45-day placement to an appropriate interim alternative educational setting due to carrying a weapon to school; or possession, use, selling or soliciting illegal drugs/controlled substances while at school or a school function) ".....(i) If the LEA did not conduct a functional behavior assessment and implement a behavior intervention plan for the child before the behavior that resulted in the removal described in paragraph (a) of this section, the agency shall convene an IEP meeting to develop an assessment plan." (34.300-39A) FBA Definitions and Purpose Although the term "functional behavior analysis" was added to federal regulations, the definition for FBA was not defined in the statute, and the U. S. Department of Education has been reluctant to supply a regulatory definition (Gorn, 1999). In the Answer Book on Discipline , Susan Gorn (1999) cites information from the federal register that this lack of definition was meant to allow the IEP team to consider on a case-by-case basis, the "situational, environmental and behavioral circumstances" (p. 4:12) in the design of appropriate assessment. She believes, as do others (Tilly et al., 1999; Quinn et al., 1998), that Congress intended for educators to apply the definition for FBA commonly used by educational psychologists and other behaviorists (Gorn, 1999).

USD Foundation The Department of Public Safety is the agency responsible for law enforcement on campus.  In addition to law enforcement, the department is  responsible for operating the Campus heating plant, Parking and Traffic Management, and Escort Services.  DPS is located in the Davidson Building, directly south of the ID Weeks Library, in the heart of campus.  Our office is open 24 hours a day, 365 days a year. Our staff is composed of full-time Police Officers and part-time Security staff.  Full-time Police Officers are sworn in as Vermilion City Deputy Police Officers and receive the same training as other City Police Officers.  Each Officer is required to attend the South Dakota Law Enforcement Academy in Pierre, SD. In addition to law enforcement, our officers respond to all medical emergencies on campus.  Subsequently, many of our officers are certified EMT's. Crime prevention and education are high priorities of DPS.  We work with all members of our community to find answers to problems and address concerns of those we serve.

PHILOSOPHY
(Established May 1, 1992) The University of South Dakota Office of Disability Services operates on the premise that students at the university are full participants in the process of obtaining accommodations for their disabilities. Rather than someone else making decisions for students, they are encouraged to enter into a dialogue which results in student ownership of their decisions. While many high school students enter the university from situations in which others have made their accommodation decisions for them, they are encouraged here to move toward independence and self-advocacy.

CONFIDENTIALITY
The Americans with Disabilities Act and Section 504 of the Rehabilitation Act are very clear that disability information is to be treated as strictly confidential. USD's policy on confidentiality is modeled on that of the U.S. Department of Education. The regulations stipulate that documentation of disability should be held by a single source within the institution in order to protect the confidentiality of persons with disabilities by assuring limited access. These rules state that disability-related information is medical information and is not subject to the Family Education Rights and Privacy Act of 194. Issues of confidentiality are particularly important for students with hidden disabilitieschronic health impairments, students with psychiatric disabilities, and students with learning disabilitieswho may wish to access their right to accommodation while minimizing the risk of stigma associated with those disabilities.

"Educating America's students is primarily a state and local issue, but the department is working to support the needs of South Dakota's disadvantaged students without unnecessary federal red tape." Following are among the highlights of the grant award programs for South Dakota:
  • Title I grants, the largest federal education activity for pre-K through grade 12, helps districts close the achievement gap between high- and low-poverty schools by targeting resources based on the number of children in poverty. Even Start, a Title I component, supports local family literacy projects that integrate early childhood education, adult literacy or basic education, as well as parenting education for families. $17.4 million.

Access to Quality Planning Document for South Dakota's Special Schools The planning process for the South Dakota School for the Deaf and the South Dakota School for the Visually Handicapped was based on the same principles which guided the development of Access to Quality for higher education. It was a participative process that included the superintendents and Board of Regents Executive Director with review and input from faculty, staff and the schools' Advisory Councils. The process began in September 1994 with a draft report to the South Dakota Board of Regents in June 1995. The document includes a chapter on the environment in which the special schools operate, as well as assumptions in a variety of areas. Assumptions were grouped into nine broad categories: Mission and Planning, Statewide, Governance, Student, Program, Staffing, Finance, Facilities and Intergovernmental Relations. In each category, statements reflect what exists or is expected to exist in the immediate future. The next section lists eleven directions which are to be pursued. The directions include: access to appropriate services, quality of programs and services, maximizing delivery statewide, creating quality teaching and learning environments, development of centers of excellence, resource management, collaborative relationships, partnerships with parents, increased public understanding of vision and hearing loss, competitive compensation for employees and maintenance of facilities and equipment. The directions are ambitious and reflect a standard of excellence. Some of the directions will require additional resources to implement and maintain. The course, however, is clear. The rate of progress may be affected by resource availability.

The thrust of S.D.'s motion to strike is that the preliminary departmental decision fails to prove a prima facie case regarding one of the three asserted grounds for the recovery of the $150,000, namely that this amount was, in fact, used to pay interest on the State's construction bond. ED filed an opposition asserting that the preliminary departmental decision need only state, in effect, a cause of action rather than prove a prima facie case. Since the preliminary departmental decision adequately asserted facts sufficient to provide S.D. with notice of the ground for disallowance, S.D.'s motion to strike, according to ED, should be denied. For the reasons stated below, S.D.'s motion is granted in part, the Order of May 6, 1991 is vacated, and the preliminary departmental decision is hereby returned to ED.
OPINION
Sections 1234 and 1234a provide the statutory authority governing the recovery of funds from a recipient of a grant or cooperative agreement. Whenever the Secretary determines that a recipient of a grant must return funds because the recipient has made an expenditure that is not allowable or has failed to properly account for the funds, the Secretary shall give the recipient written notice in the form of a preliminary departmental decision and must notify the recipient of its right to have that decision reviewed by the Office of Administrative Law Judges. Section 1234a(a)(1).
