TNRCC reminds at-risk individuals to monitor air quality Central, South and East Texas are in the grip of a hot, stagnant weather system which combined with industrial and vehicle emissions has caused unusually high ground-level ozone readings for much of the state in late June. San Antonio, Austin, Dallas-Fort Worth, Houston-Galveston, and Longview-Tyler have each had multiple days exceeding the federal ozone standard in June, which according to historical data is one of the milder months for high ozone readings. Readings tend to peak in August and September, according to state records. "We encourage all Texans to be aware of these conditions, and to plan activities accordingly, said TNRCC Chairman Robert J. Huston. "Clean air is, along with clean water, our most precious natural resource. Citizens must be willing to take the necessary actions to reduce emissions that lead to unhealthy air quality." Ground-level ozone is a known respiratory irritant, and can be particularly troublesome for older individuals, children, and persons with chronic respiratory conditions such as asthma and bronchitis. Current ozone readings are available at the TNRCC website at www.tnrcc.state.tx.us, and can be reached through the "Ozone in Texas" link on the home page.

Texas Cities Join Forces To Force Local Telephone Competition:
Rural Telephone Coop Competes with GTE Thirty-four Texas cities have joined together to seek competition in local telephone service for their communities. Meanwhile, three years after the Texas legislature enacted competition for local telephone service, a rural telephone cooperative is emerging as the region's only competitor to incumbent GTE Southwest Inc. (GTE), forcing the former monopoly to upgrade its system or lose customers. Texas Cities for Local Phone Competition, a group of cities whose telephone franchise contracts will soon expire, issued a Request for Statements of Interest in March, inviting telephone companies to propose how they would compete with GTE to serve local telephone customers in its member cities. Member cities are offering new 5-10 year franchise agreements to potential GTE competitors. Coalition members believe exercising their franchise authority is the needed to upgrade local telephone service that GTE does not offer in many communities, from local and long distance services to internet access, cable TV, Caller ID and high speed data transmission. In Texas, as in most of America, local telephone monopolies remain largely unchallenged despite the legalization of local telephone competition in to recent amendments to the Federal Telecommunications Act and the Texas Public Utility Regulatory Act. "We are asking other companies to come in and compete with GTE," said Austin attorney Jim Boyle, who represents the coalition of Texas cities. "Concerted action is needed to make local telephone competition a reality instead of just something which hypotehetically could be done," he added.

Local Legal Issues
Texas, and Dallas/Fort Worth in particular, makes patchwork of laws regarding ferrets. There is no statutory law that either specifically prohibits ferret ownership or specifically recognizes their status as pets. Since 1993, when Texas Parks and Wildlife Department rules were changed to eliminate language that could have been inappropriately interpreted the define the domestic ferret as a wild weasel, there has been no state level code which could be considered to ban pet ferrets.     The Texas Cities Coalition on Stormwater (the "Coalition") is a group of 91 Texas cities who have joined together to the address serious and significant issues raised by EPA’s Phase II Storm Water Program, particularly those issues relating to the regulation of small municipal separate storm sewer systems ("Small Cities"). The participating cities represent a broad geographic and demographic cross-section of small Texas cities, including cities that are listed by EPA as "automatically designated" and "potentially designated " under EPA’s proposed Phase II MS4 program. The members of the Coalition are committed to protecting the health and welfare of their citizens and in preserving the environment. The members of the Coalition are concerned that EPA’s approach to implementing the Phase II MS4 program will cost too much, divert too many municipal resources from more pressing priorities, and will achieve little or no improvement in water quality. Additionally, the members of the Coalition believe that EPA’s proposal fails to properly recognize the sovereignty of local governments and, as such, oversteps the limitations on EPA’s power imposed by the United States Constitution. The real issue is not whether EPA mandated programs such as public education programs and construction site runoff control programs are good or bad. Rather, the issue is who will pay for these programs, who will bear the political risk if the programs fail to gain popular support, and who dictates municipal spending priorities. EPA is trying to use local tax revenues and local government authority and manpower to carry out EPA

    PHARR — City commissioners Tuesday agreed to pay an additional $2,333 to a coalition fighting against federal regulations.
    The Texas Cities Coalition on Stormwater, a group of more than 90 Texas cities, is challenging the U.S. Environmental Protection Agency’s Phase II stormwater regulations. Issued in 1999, the regulations mandate that discharges from small municipal storm sewer systems, like Pharr’s, and from construction sites between one and five acres in size, be subject to national permitting requirements.
