Art. 4495c. Intractable Pain Treatment Act Short Title Sec. 1. This article may be cited as the Intractable Pain Treatment Act. Definitions Sec. 2. For the purposes of this Act: (1) "Board" means the Texas State Board of Medical Examiners. (2) "Physician" means a licensee of the Texas State Board of Medical Examiners. (3) "Intractable pain" means a pain state in which the cause of the pain cannot be removed or otherwise treated and which in the generally accepted course of medical practice no relief or cure of the cause of the pain is possible or none has been found after reasonable efforts. Prescription or administration of drugs by physician Sec. 3. Notwithstanding any other provision of law, a physician may prescribe or administer dangerous drugs or controlled substances to a person in the course of the physician's treatment of a person for intractable pain. Restriction by hospital or health care facility of prescribed drug use prohibited Sec. 4. No hospital or health care facility may forbid or restrict the use of dangerous drugs or controlled substances when prescribed or administered by a physician having staff privileges at that hospital or health care facility for a person diagnosed and treated by a physician for intractable pain.

At the request of the Council of the Appellate Practice and Advocacy Section of the State Bar and the Board of Directors of the State Bar of Texas, and based upon their submission to our Courts, the Supreme Court of Texas and the Texas Court of Criminal Appeals hereby adopt and promulgate the attached Standards of Appellate Conduct. Nothing in these standards alters existing standards of conduct under the Texas Disciplinary Rules of Professional Conduct, the Texas Rules of Disciplinary Procedure, or the Code of Judicial conduct.
STANDARDS FOR APPELLATE CONDUCT
Lawyers are an indispensable part of the pursuit of justice. They are officers of courts charged with safeguarding, interpreting, and applying the law through which justice is achieved. Appellate courts rely on counsel to present opposing views of how the law should be applied to facts established in other proceedings. The appellate lawyer's role is to present the law controlling the disposition of a case in a manner that clearly reveals the legal issues raised by the record while persuading the court that an interpretation or application favored by the lawyer's clients is in the best interest of the administration of equal justice under law. The duties lawyers owe to the justice system, other officers of the court, and lawyers' clients are generally well defined and understood by the appellate bar. Problems that arise when duties conflict can be resolved through understanding the nature and extent of a lawyer's respective duties, avoiding the tendency to emphasize a particular duty at the expense of others, and detached common sense. To that end, the following standards of conduct for appellate lawyers are set forth by reference to the duties owed by every appellate practitioner.

(a) In this section, "covert entry," "communication common carrier," "contents," "electronic, mechanical, or other device," "intercept," "investigative or law enforcement officer," "oral communication," "electronic communication," "readily accessible to the general public," and "wire communication" have the meanings given those terms in Article 18.20, Code of Criminal Procedure.
~ (b) A person commits an offense if he:

Spoliation of Evidence: A Survey of Texas Law
Oliver Wendell Holmes once said that "[t]he law embodies the story of a nation's development through many centuries, and it cannot be dealt with as if it contained only the axioms and corollaries of a book of mathematics." Unfortunately, this statement accurately describes the current Texas law on spoliation of evidence in that there are few hard and fast rules concerning the destruction of evidence. The best way to determine the law in your jurisdiction is to review the specific history of the court you are in. A. What is Spoliation? Though the Texas Supreme Court has not defined the term spoliation and different jurisdictions have applied different definitions to the term, the term broadly refers to the intentional, reckless, or negligent destruction, loss, material alteration or obstruction of evidence that is relevant to litigation. It is, however, still unclear if spoliation includes both negligent and intentional destruction of evidence, the loss of evidence, and/or evidence that was destroyed before litigation began.
