Published Thursday, February 18, 1999, in the Miami Herald U.S. officials and international human rights groups on Wednesday condemned a new Cuban law that creates a broad, new category of counterrevolutionary crimes for government opponents. The National Assembly of Peoples Power approved the law Tuesday, along with an overall tightening of the island's penal code, but set the maximum penalty at 20 years in prison, instead of the 30 initially proposed. Patrick Boudouin, head of the Paris-based International Federation of Human Rights Leagues, called the law ``scandalous and said Havana ``has taken off the mask of relative tolerance it wore for the past year. Reporters Without Borders, a French group that works for freedom of expression, said the new law would severely trouble the 40 or so opposition journalists now active around the island. The Miami-based Inter American Press Association, which represents about 1,300 news media outlets in North America and Latin America, said the law ``elevates censorship to the status of law. U.S. State Department spokesman James Foley branded it ``a clear attempt to silence independent thinking and civil society in Cuba.

U.S. says Cuba continues to trample on rights
By Anthony Boadle W ASHINGTON, Jan 30 (Reuters) - Cuba's communist government continued to systematically violate civil and political rights on the island in 1997, the United States said on Friday. Restrictions on religious practice were relaxed prior to last week's visit by Pope John Paul II, but Cuban authorities continued to repress dissidents in the one-party state, the U.S. State Department said in its annual report to Congress on human rights around the world. "Cuba is a totalitarian state controlled by President Fidel Castro," the report stated bluntly. It said freedoms of speech, press, assembly and association did not exist in Cuba, and the judiciary was subordinated to the ruling Communist Party. "The authorities routinely continued to harass, threaten, arbitrarily arrest, detain, imprison, and defame human rights advocates and members of independent professional associations, including journalists, economists, and lawyers, often with a goal of goading them into leaving the country," the report said. "There were several credible reports of death due to excessive use of force by the police," it added.

INTERNATIONAL ASSOCIATION OF FIRE FIGHTERS LOCAL F-89 (Union) and U.S. DEPARTMENT OF THE ARMY HEADQUARTERS, FORT SAM HOUSTON FORT SAM HOUSTON, TEXAS (Agency) 0-AR-2668 DECISION April 7, 1995 Before the Authority: Phyllis N. Segal, Chair; Tony Armendariz and Pamela Talkin, Members. I. Statement of the Case This matter is before the Authority on exceptions to an award of Arbitrator Fallon W. Bentz filed by the Union under section 7122(a) of the Federal Service Labor-Management Relations Statute (the Statute) and part 2425 of the Authority's Rules and Regulations. The Agency filed an opposition to the Union's exceptions. The Arbitrator sustained the grievance over the suspension of the grievant. As a remedy, the Arbitrator ordered that the grievant be made whole for any loss of pay or benefits, but did not award attorney fees or compensatory damages. The Union contends that the award is deficient because it did not award compensatory damages and attorney fees. We find that the Union fails to establish that the award is deficient under section 7122(a) of the Statute. Accordingly, we deny the Union's exceptions. II.

Saturday, January 11, 2003 Slashdot Your Rights Online Supreme Court Takes Nike Free Speech Case MacAndrew writes "The Supreme Court has granted review in a case previously discussed here that could lead to a landmark decision regarding "commercial speech." The California Supreme Court had ruled that Nike's statements denying the use of sweatshop labor in Asia could be challenged under the state's strict truth in advertising laws, under which truth is not a defense if a statement's context is deemed misleading, First Amendment notwithstanding. The California court essentially rejected Nike's claim to heightened political speech protection which would have allowed the company to raise defenses of truth and due care reasoning that Nike's statements were calculated to induce product purchases and thus commercial speech. The U.S. Supreme Court's consideration of this case provides a clear opportunity to reconsider the controversial political-commercial speech dichotomy in constitutional law. It is essential to bear in mind the question at this point is not whether Nike did anything wrong, rather to determine the standards by which it will be judged. Thurgood Marshall Law Library
The Thurgood Marshall Law Library is a selective depository. We do not receive every item available from the Government Printing Office. The Library does make every effort to choose material reflecting the research needs of our students and faculty. Many, but not all, of the documents that the Library receives are cataloged and can be located by searching in the VICTOR computer system. If you are unable to locate the material you need, please ask for help at the Library's Information Desk. Material is arranged on the shelves by the Superintendent of Documents (SuDoc) number. This number usually consists of an alphabetic identifier for the agency (Ag for Department of Agriculture, J for Department of Justice) followed by a series of numbers that represent both the type of publication and the year or congressional session the material was produced. Congressional publications are always represented by either an X or Y. When you are using an electronic index such as the Monthly Catalog or a printed index, such as CIS, you need to locate the SuDoc number in order to find material on the shelves.
