Youth Advocacy Program
(Monroe, Genesee, Orleans and Livingston Counties)
Purpose
The purpose of the Youth Advocacy Programs is to provide legal representation, educational advocacy, advice and counsel to youth and their families in education related cases. Cases can involve issues of access to school, residency, special education and long term suspension.
What We Do
We provide representation of youth suspected or identified as having a disability in school proceedings such as:
  • Committee on Special Education meetings
  • Section 504 meetings
We provide representation of youth who are charged with school misconduct and/or violation of the school's code of conduct in school proceedings such as:
  • Superintendent hearings
  • Long-Term Suspension hearings
We provide representation, counseling, and referral to resolve issues involving residency and rights of students to enroll in school.
We provide information, referral, and consultation on issues listed above and other issues such as:
  • Legal rights and responsibilities of youth, parents, and schools
  • Strategies to address and resolve concerns and problems
  • Run-away and homeless youth
  • Emancipation
  • Individualized Education Programs (IEP) and 504 Plans
Who Qualifies for the Program
  • Children and youth from birth to age 21 and their families
  • Residents of Monroe, Genesee, Livingston, or Orleans Counties

GRANTEE PROFILE REQUEST FOR PROPOSAL PREVIOUS RECIPIENTS Youth Advocacy and the House of Latex Project Peer Education Retreat Gay Men's Health Crisis House of Latex Project is a peer-based HIV prevention, education and outreach program helping the youth and young adults of New York City's vibrant house and ball community as they struggle with the continued impact of HIV and AIDS. More than ten years ago, Gay Men's Health Crisis began sending outreach workers to balls to distribute condoms. That effort has grown into the longest running HIV prevention program dedicated to the house and ball community in the country. DIFFA granted funds that helped the House of Latex Project host a peer education and training retreat in January 2001. The retreat was a rousing success and has resulted in critical growth and development for the House of Latex Project as they prepare for another retreat in the upcoming year.

We work in Burlington, that is where the majority of our work is with Club Speak Out around Chittenden County, and I am just going to read off our vision and our mission to give you an idea of what Club Speak Out is and our goals. Our vision is Club Speak Out envisions the ability for youth to take the initiative without any constraints, being able to embody positive outcomes in our own lives with the feelings of being valued by the community through interests that arise in the area of youth development. And our mission is, Club Youth Speak Out's mission has become a resource for all the youth in all aspects of their life, empowering youth to help themselves in creating healthy developmental programs and resources that will impact their lives positively, using businesses, legislators, schools, the community, and any other area where outcomes can be positive. And that is what this program was designed for, was to go out in Chittenden County and we worked in Burlington to build a model and to give children something to do, take them out of risky behavioral situations and put them where the outcomes can be positive. And what we are here today is to ask a question: Another thing is increase the ability for youth to utilize the resources that state and federal representatives offer; more awareness for youth to be able to come to your office or come to Senator Jeffords' and Leahy's office and their local governments and be able to come up and say, This is an issue that we have, how can you help us, what steps do we have? And then form youth governmental boards that have the ability for youth to have a say in working and forming youth policies in accordance with adult policymakers, and we feel that that is real important.

Public Defender Division Offices, Resources and Cases Youth Advocacy Project (YAP) Appeals Unit
The Public Defender Division has a statewide Appeals Unit, based in the Boston office, whose lawyers provide appellate advocacy in cases tried by Public Defender Division attorneys. The Appeals Unit lawyers represent clients before the Massachusetts Appeals Court and the Supreme Judicial Court, and occasionally in federal court. The Appeals Unit, led by Chief Appellate Attorney Brownlow Speer, is known statewide for the excellence of its written and oral advocacy. Senior Trial Counsel Training and Supervision Training and supervision are particularly important components of the Public Defender Division’s ethic. Written supervision guidelines are utilized to ensure that all attorneys receive careful supervision and guidance as they handle the serious cases which make up the Public Defender Division’s work. New Public Defender Division attorneys attend an in-house, four-week training program conducted in September by the CPCS Training Unit. The new lawyer training program combines an in-depth review of Massachusetts substantive and procedural criminal law with a highly intensive trial skills training component. Over the four weeks of the course, more than fifty staff Public Defender Division attorneys, investigators and social workers assist in the training of the new lawyers.

This program began operation in 1990. This project targets youth in detention for 30 days or more to secure their release. These youth are juvenile offenders or juvenile delinquents charged with designated felonies who, absent program intervention, would likely remain in detention from two months to one year. The project will prepare client-specific release plans, provide intensive case management services for all youth released, and promptly notify the court of significant violations. New York State
