Publié sur le web le 6 Février 2003 Harare THE government has withdrawn charges against 41 white farmers hauled before the courts last year when they failed to vacate their properties to make way for blacks resettled under a controversial land reform programme, it was learnt this week. Colin Cloete, the president of the Commercial Farmers' Union (CFU), which represents most of Zimbabwe's white farmers, said by the end of last week, charges had been withdrawn against at least 41 farmers. "So far six farmers in Beitbridge, 14 in Nyamandlovu, two in Mutare and 14 in Marondera had their cases withdrawn," said Cloete, whose case, together with that of four Chegutu farmers, has also been dismissed.

Jane Standley reports from Harare: Many are demanding change
Workers have been protesting about the deteriorating economic and political situation, and demanding a 20% wage rise, as well as wide-ranging reforms. People are asking if President Mugabe - Zimbabwe's leader for all its 18 years of independence - may be about to lose power. Business is not booming With inflation at 40% and interest rates at 50%, customers in the capital Harare's poor townships are bitter and frustrated. Many Zimbabweans now make their own clothes instead of buying them "They are very angry because there is no money," Samuel MacKenzie, a Harare entrepreneur says. The Zimbabwean dollar has collapsed. People can afford little. They are sewing clothes instead of buying. Many are walking to work. The price of petrol has gone up 67% this month.

Squatters are seeking to claim white-owned land
Squatters occupying farm land in Zimbabwe will be able to remain there longer if the Zimbabwe Government succeeds in a legal action which is expected to be brought to court on Thursday. A High Court ruling on Friday gave thousands of black squatters 24 hours to leave the white-owned farms which are being occupied, and ordered the police to evict them if they did not move. But the government, which supports the redistribution of white-owned land to black farmers, has announced it will seek to "vary" the court's decision. The squatters have so far defied the High Court ruling, and the police have made no moves to evict them.
Landowners have come under attack on some of the farms
Attorney-General Patrick Chinamasa said he held talks with the police chief to assess the "rather volatile and fluid situation" and the "security implications" of police intervention. "We concluded that we should take steps to place before the High Court certain available information on the basis of which the court would be asked to vary the order it granted," Mr Chinamasa said.

Harare - Chief Justice Anthony Gubbay on Monday publicly rebuked President Robert Mugabe's government for "harassment" of Zimbabwe's judiciary. In his customary remarks at the opening of the legal year - his only speech outside the confines of legal cases put before him - the 69-year-old jurist denounced the authorities' refusal, on Mugabe's orders, to enforce repeated judicial rulings for action to end the violence by ruling Zanu-PF party activists. Since Mugabe lost a constitutional referendum last February they have targeted political opponents and occupied 2 500 white-owned farms, saying they are agitating for the "fast track" land reform announced by Mugabe. Seven white farmers and at least 32 black Zimbabweans suspected of supporting the opposition MDC have been murdered but none of the killers brought to justice. Justice minister Patrick Chinamasa and Home Affairs minister John Nkomo boycotted Monday's ceremony attended by 11 of Zimbabwe's 27 judges at the High Court. The ministers' reserved seats were left conspicuously vacant as diplomats, including acting German ambassador Werner Kohler and heads of the legal profession, crowded the courtroom amid strict security. Four of Zimbabwe's six white judges were present among the scarlet-robed jurists. Gubbay said judges' orders demanding an end to lawlessness were "not to prevent the government from pursuing land resettlement. This has never been the aim or policy of the courts which unhesitatingly accept that the past inequities in the distribution of land must be redressed urgently," he said.

Harare - The government, which detained two opposition party leaders this week, is considering a petition to ban that party's open hand salute, state television reported Thursday. A group of ruling party lawmakers and fundamentalist Christian clerics said the MDC's salute gives political connotations to normal greetings and farewells. The petition, submitted Wednesday, said the open hand waving motion meant those not affiliated to the party were uncomfortable when meeting or leaving loved ones, the Zimbabwe Broadcasting Corp. reported. "Waving hands is an international symbol of happiness created by God and using it on political grounds is a total violation of human rights," the petition said. The opposition party launched the open hand salute on its formation in 1999 to denote openness against the clenched fist salute of President Robert Mugabe's ruling party, in power since independence in 1980. The opposition on Thursday dismissed the petition as a "laughable" propaganda ploy nearly two years after the salute and slogans calling for change were adopted. State television said the petition was drafted by three ruling party lawmakers and clerics from the Emakhandeni Church of Christ, a fundamentalist group in western Zimbabwe. In June parliamentary elections, the opposition won 57 seats, leaving the ruling party with a slim majority of the 120 elected seats. In the previous parliament, Mugabe controlled all but three seats. Earlier this week, police accused MDC deputy leader Gibson Sibanda and youth wing head Nelson Chamisa of incitement to violence, which carries a fine and possible imprisonment. The party said it was part of a continuing clampdown on government opponents. Welshman Ncube, MDC secretary general, said both denied charges of incitement at rallies in Bulawayo and Harare on Sunday.

Zimbabwe: Government steps up harassment of human rights defenders

Amnesty International condemns efforts by the Zimbabwean government to silence human rights defenders. Recent statements by government ministers signal intensified scrutiny and intimidation of NGOs who have spoken out about the deteriorating human rights situation in Zimbabwe.
"Human rights organizations who expose human rights violations and are perceived to be critical of government policy are coming under increasing attack," Amnesty International said today.
Amnesty International calls upon the Zimbabwean government to respect the United Nations Declaration on Human Rights Defenders and to immediately end its intimidation and harassment of human rights organizations and other human rights defenders.
"The authorities must enable human rights defenders to work without fear of intimidation or arrest. The Zimbabwean authorities and the international community should ensure that impartial and independent public investigations are carried out into human rights violations and that those responsible are brought to justice" said Amnesty International.

Instead, the government is to amend its controversial media law. The disputed media bill originally was scheduled to be pushed through the Zimbabwean parliament on Tuesday, but was adjourned. The bill was designed to silence the independent media and to ban foreign journalists from working in Zimbabwe. Further, local journalists would have to register with the government or face two years imprisonment. The bill was opposed to by the entire opposition and even criticised from the government party's own benches. Further, President Mugabe on Monday had assured his fellow Southern African presidents of his "commitment to freedom of expression as guaranteed by the constitution of Zimbabwe," and reaffirmed the "practice of allowing national and international journalists to cover important national events, including elections."

The EU observer mission sent to watch the election in Zimbabwe were not happy about the "climate of fear" and that the "Zanu-PF leaders seemed to sanction the use of violence and intimidation" Looked at from the point of view of the working class revolutionaries have three essential points to make. 1. Zanu-PF has always been a force for capitalism and against the working class. "Zimbabwe will never be a colony again". In practice, in a country like Zimbabwe, the big powers, using all the means at their disposal, not least the IMF, will do their best to ensure that the local state fits in with their imperialist needs. Zanu-PF has tried to mobilise the black population outside the cities against white farmers. But, ultimately, whether the land is controlled by the state or divided into peasant small-holdings, it will not mean any improvement in the conditions of life in rural Zimbabwe. 2. Multi-party democracy in Zimbabwe expresses the dictatorship of capital just as much as the one-party state.

Zimbabwe Government Gives No Safety Guarantee to Journalists Amidst Restrictions on Foreign Media The International Federation of Journalists, the world's largest organisation of journalists, today condemned the government in Zimbabwe for refusing to guarantee the safety of journalists and for undue restrictions on foreign reporters. A meeting between Minister of Information and Publicity Jonathan Moyo and an IFJ fact-finding delegation led by IFJ Executive Member, Farhana Ismail and Basildon Peta, President of the Zimbabwe Union of Journalists (ZUJ), ended in a shambles today, with the Minister of Information refusing to discuss any of the concerns raised by the delegation. The government failed to show concern or any action on the issues raised by the delegation. When pressed for safety guarantees for journalists, foreign and national alike, the Minister walked out of the meeting, saying aloud, "I have better things to do with my time".
