Associato di Psichiatria, Specialista Neuropsichiatria, Genova Un concetto fondamentale guida lo psichiatra del XIX secolo: la società moderna "degenera" perché la complessità e la dinamica della rivoluzione industriale rendono difficile l'esistenza ai soggetti deboli e meno adatti alla lotta per la vita; di riflesso i "residui asociali", gli individui sconfitti si esprimono con un forte disagio psichico, ossia con la malattia mentale.
L'imputabilità non deve quindi essere basata su di un concetto astratto "metafisico", ma deve trovare le fonti in un accurato e globale esame antropologico di chi ha commesso un reato, ossia occorre esaminare tutte le condizioni sociali, fisiche, neurologiche e psichiatriche del soggetto: per Lombroso, soltanto valutando tutti questi dati, oltre che quelli sociali ed economici, ossia l'insieme dei molteplici fattori coagenti all'origine del fatto delittuoso, può essere emesso un corretto giudizio di imputabilità "con giustizia e verità" (
Tuttavia Morselli, da esperto clinico, critica l'idea di degnerazione, così vasta e scientificamente di difficile delimitazione, in quanto egli ritiene che in realtà sia "un fattore oscuro interno dell'organismo" che è facile tirare in ballo per interpretare polimorfe patologie mentali e neurologiche. Degenerazione è un concetto troppo vasto e onnicomprensivo che serve a spiegare patologie spesso indice di vere e proprie malattie, come infezioni, tumori, atrofie cerebrali. Egli quindi pensa sia utile, per la psichiatria, restringere l'approccio degenerativo, sorta di "deus ex machina", e allargare e approfondire l'interpretazione clinico-etiologica (

LE ORIGINI DEL PENSIERO CRIMINOLOGICO
Le leggi, scritte o tramandate oralmente, sono sempre esistite ancheprima del diciottesimo secolo, periodo in cui, secondo gli studiosi, nasce ilsistema penale moderno e con esso la Scienza Criminologica. Fino ad allora ilpotere assoluto del sovrano di infliggere le punizioni, indipendentemente dalcrimine commesso, aveva caratterizzato sovente l’applicazione delle norme elargo spazio era affidato alla tortura ed alla pena di morte .Certamente, anche nell’ambito di civiltà antiche e medioevali è documentatal’esistenza di protocodici e di strutture di applicazione delle pene anchesofisticate in alcuni intervalli temporali (es. il diritto romano), ma ladiscontinuità, la barbaria e l’arbitrio di tale applicazione non consentono diriconoscere una condizione di civiltà deldiritto , prima della metà del settecento, nei termini in cui essa vieneintesa attualmente. La pena veniva infatti soprattutto intesa come sistema dimantenimento del potere e dei privilegi dei nobili, di frantumazione deldissenso e talvolta come capriccio e, in generale, si assisteva ad un’assolutamancanza di coerenza delle punizioni oltre che, naturalmente, alla loro inaudita violenza.

An Optimist Beginning Towards 1910, when many countries in the area were celebrating the 100th anniversay of their first struggles for independence, Latin America could be seen finally as a success story. Progressive elites imbued with the scientific spirit of the times were in power almost everywhere, administering economic growth and modernization. A look backwards was necessary in order to appreciate the scope of progress, interpreting it within the outlines of evolutionary thought, which had superseded an earlier version of liberal constitutionalism. The one cloud in an otherwise limpid sky was that serious social violence had not yet been totally erradicated, and in fact was passing from rural settings to industrial ones. Finally in Mexico the immense reservoir of the peasants exploded, and this made a difference. The difference was a million dead, and since then Latin American politics could never be the same again.
