No. 3386 Philadelphia 1998 Appeal from the Order dated October 28, 1998 Docketed October 28, 1998 in the Court of Common Pleas of Philadelphia County Civil No. October Term, 1996, 1039 BEFORE: DEL SOLE, MONTEMURO*JJ. and CIRILLO, P.J.E.
Filed: July 23, 1999 OPINION BY
MONTEMURO, J.:
This is an appeal from an order granting the summary judgment motion of Appellees, Hospital of the University of Pennsylvania and Penn Health Systems, in an action for negligence and lack of informed consent. At the age of two, Appellant, now 36, was diagnosed with Ollier's disease, a rare disorder of the skeletal system which produces multiple benign cartilaginous lesions, leaving the bones brittle and susceptible to breakage. The disease eventuated in the amputation of Appellant's right foot in 1975, as well as surgical procedures on, inter alia, his left ankle and his wrist. Appellant has also suffered from a heart murmur since infancy, and was in recent years diagnosed with high blood pressure. He has been in a wheel chair since 1985, and underwent surgery in 1987 for removal of a benign cartilaginous growth in his brain. In 1994, Appellant was referred to Dr. Robert Zager, a neurosurgeon on staff at Appellee Hospital, for treatment of a previously diagnosed brain tumor. Because the symptoms with which Appellant presented to Dr. Zager had been accompanied by skin lesion

Small tumors called enchondromas can sometimes form in the bone beneath the toenail.
An enchondroma is a fairly common benign tumor, which is the most common bone tumor of the hands and feet. The tumor can involve large portions of the bones, causing thinning of the cortex. This can weaken the bone and cause it to break spontaneously. When enchondromas occur in the small bone in the end of the toe, they can cause pain that may mimic the pain of ingrown toenails. Ollier's Disease , also known as enchondromatosis, frequently occurs in the small bones in the hands and toes (phalanges) and the long bones behind the phalanges called metatarsals. Maffucci's Syndrome is a very rare form of enchondromatosis associated with multiple soft tissue hemangiomas. This tumor frequently occurs in the hands and feet, and has a greater tendency toward malignant transformation than Ollier's Disease

Achondroplasia Osteogenesis Imperfecta (OI) This condition represents a group of inheritable disorders caused by abnormal type I collage synthesis. Aberrant collagen deposition in osteoid synthesis leads to "brittle bones". This condition may confuse social and health care workers in cases of potential child abuse. Clinical: Type I (A.D.) Multiple fractures in infancy. Blue sclera Poor dentition Hearing loss Kyphoscoliosis Type II (A.R.) Perinatal death Osteopetrosis (Marble bone disease of Albers-Schonberg) . Rare disease inheritable as either dominant or recessive trait. Recessive form is fatal during neonatal/infant stage. Clinical: Cortical overgrowth Pathologic fractures Anemia Cranial nerve entrapment Prognosis: Variable with bone marrow transplant. Metabolic Disease Osteoporosis Rickets/Osteomalacia Hyperparathyroidism This condition results from excessive PTH release. The primary form results from hyperplastic parathyroid tissue. The secondary form is typically a consequence of renal failure. Unchecked PTH release stimulates osteoclasts to resorb bone. Patients suffer from changes ocurring in bone and from the hypercalcemia that develops. Clinical: Osteitis fibrosa cystica Brown tumor Hypercalcemia Pathologic fractures
