1-0 out of 5 stars Complexity Where Simplicity is Needed: Discourse on Kutner's
Law professors should never co-write a book.Therein no two people shouldever co-author a manuscript.It is obvious that Peter Kutner, tort expert,is the predominant voice in this book.Research on the background of Kuterand Reynolds shows a research professor pitted against a trial, classroomprofessor.Kutner is seen all the over the book due to his complexity. This is why the book is so distasteful is because Kutner like his usualstyle makes tort law too hard to understand and he cannot communicateeffectively. The only area where Kutner shines is in the defamationsection.Kutner is an expert at defamation, libel, slander, publicfigures, the First Amendment, and the best serum against defamation, laverdad: the Truth which as Jesus said sets you free.But, Kutner stillcannot communicate the point effectively.For example, Kutner could take awhole hour explaing third party liability and no one would understand.Andthe simple explination could be done by a high school history professor. If a man parks too far out into the street and one car must pass thewrongly parked car, and thus a wreck insues due to blockage of the streetthe man who parked wrong is liable.And there you are, the explination. Kutner also shows too much focus on Enlgish common law and there by assumesthat the US system of injustice is based on English common law forinterpretation of American juris prudence.While study of all forms of lawindicate the American system of injustice is based on both common law andstatutory law combined.The American system of current injustice is basedon the evolution of good statutory law such as the Code of Hamurabi, theCode of Justinian, tribal law (which Osborne Reynolds does write aboutquite well), the Bible, the Magna Carta, the Declaration of the rights ofman, and the Bill of Rights itself, definately inspired by DivinityHIMSELF. Also, Kutner does not build up a good background and backup ofsimple torts in reference to complex Torts 3.People must totally knowIntentional Torts, negligence, product liability, etc. to apply tointentional causation of breach of contract or marriage torts. In all,stay away from this book.Stay away from Kutner's classes, becausecomplicated writing leads to complicated discourse which leads to madnesson Kutner's final.Finally, stay away from the so called College of Law inwhich these gentlemen teach.Remember birds of a feather flock together. And in all cases this probably means there are others there who can'texplain property law, or make criminal law way too ward due to musiciangenius, or all zealous in preserving the law school, or just can't help youlearn the law.In the end, most of what you study for 400,000 hours tosurvive and end up to get a B-/C+ from these people is not worth theeffort.English common law and American common law/statutorylaw/historical law mix have nothing in common and should not be based oneach other.Trust me I should know about this a little since ah live inScutland.My voice never seems to translate to enscription. ... The concept was introduced by George Gabriel Stokes in 1851, but the Reynolds number is named after Osborne Reynolds (1842?1912), who popularized its use in 1883. She is best known for her game-winning penalty against China in the 1999 FIFA Women's World Cup final and her bra-baring celebration afterwards. She attended Archbishop Mitty High School in San Jose, California, helping take the team to three section championships. In 1986 Chastain was awarded the Soccer America Freshmen Player Of The Year award at the University of California-Berkeley. Soon after, she underwent reconstructive surgery on both knees which caused her to miss much of the 1987 and 1988 seasons.
