National Association of Attorneys General Hosts National Meeting on Domestic Violence Committed in the Presence of a Child
February 5, 2002 The National Association of Attorneys General (NAAG) is hosting a national meeting on Domestic Violence Committed in the Presence of a Child on February 6-7, 2002, in its Washington, D.C. headquarters. The meeting, coordinated by NAAG’s Violence Against Women Project, is being held to develop a research agenda related to criminal statutes addressing domestic violence committed in the presence of a child. "This is a tremendous undertaking by NAAG with a significant opportunity to affect public policy in the area of domestic violence," said Nevada Attorney General Frankie Sue Del Papa, Convener of NAAG’s Violence Against Women Committee. "Because of the growing awareness of the consequences resulting from exposure to domestic abuse, states have been exploring diverse means of protecting children from violence in their homes." Delaware Attorney General Jane Brady is scheduled to speak at the meeting on Wednesday afternoon to discuss her state’s vigorous initiatives in prosecuting domestic violence crimes involving children. Delaware’s initiatives have been evaluated by a team from the National Association of Attorneys General (NAAG) and are being praised as a model for other states. After a preliminary review of efforts undertaken in many states, the study team was most impressed with Delaware's initiatives and selected the state for a site visit to learn more. General Brady hosted the team in December.

    Violence Against Women Act The Violence Against Women Act (VAWA) which was passed in 1994, marked a significant movement in response to domestic violence, sexual assault, and stalking. This Act requires a collaborative effort in developing a system of response to these crimes between law enforcement, prosecutors, health care providers, and nonprofit groups. Through the Federal Government's pledge of significant funds to improve the present system's response to victims of these crimes, each state can become more efficient in guaranteeing the safety and well-being of all women. National Institute of Justice South Carolina's Response Under the Violence Against Women Act, The South Carolina Attorney General's Office has received a grant from the Department of Justice to develop state-of-the-art law enforcement protocols and aggressive prosecution procedures for criminal domestic violence, criminal sexual conduct, and stalking crimes. Under this Violence Against Women grant, the development of such procedures will result in the creation of South Carolina's first comprehensive, collaborative approach to combating these crimes.     A 2001 study by the Centers for Disease Control revealed that one in five high school girls has been physically or sexually abused by a dating partner, significantly increasing their risk for drug abuse, eating disorders, suicide, and other harmful behavior. Programs and Resources

      • If there is an argument, try to be in a place that has an exit and not in a bathroom, kitchen, or room that may contain weapons. Practice getting out of your home safely. Identify which doors, windows, elevator, or stairwell to use. Pack a bag and have it ready at a friend's or relative's house. Identify one or more neighbors you can tell about the violence and ask them if they can call the police if they hear a disturbance coming from your home. Devise a code word to use with your children, family, friends and neighbors when you need the police. Decide and plan where you will go if you ever have to leave home. Use your instincts and judgment. In a dangerous situation, placate the abuser if possible, to keep him or her calm.
      Remember: You Do Not Deserve to be Hit or Threatened When Preparing to Leave

    Domestic Violence Court (DVC) Program
    Ontario's Domestic Violence Court (DVC) program is the most extensive DVC program in Canada. It facilitates the prosecution of domestic assault cases and early intervention in abusive domestic situations, provides better support to victims and increases offender accountability. In a DVC program, teams of specialized personnel, including police, Crown Attorneys, Victim/Witness Assistance Program (VWAP) staff, probation services, Partner Assault Response (PAR) program staff and community agencies, work together to ensure priority is given to the safety and needs of domestic assault victims and their children. An operational DVC includes the following components:
    • A Domestic Violence Court Advisory Committee
    • Specially trained domestic violence Crowns, VWAP staff, and interpreters
    • Specialized evidence collection and investigation procedures by police
    • Case management procedures to coordinate prosecutions and ensure early intervention
    • A Partner Assault Response intervention program
    • Expanded training for police, Crowns, VWAP staff, court staff, Probation and Parole staff, and interpreters

    How 'domestic violence' is defined Disagreements develop from time to time in relationships. Domestic violence is not a disagreement. Domestic violence encompasses a wide range of acts committed by one partner against another in an intimate relationship. This may occur in a variety of relationships: married, separated, divorced, dating, heterosexual, gay or lesbian. Violence of a particularly injurious nature is primarily perpetrated by men against women. Domestic violence is a pattern of behaviors, some causing physical injury, others not, some criminal, others not, but all psychologically damaging. Frequently, domestic violence includes threats of violence, threats of suicide, or threats to take children from the abused person. It may also include breaking objects, hurting pets, yelling, driving recklessly to endanger or scare the abused person, isolating family members from others, and controlling resources like money, vehicles, credit, and time.     WHAT IS THE DIFFERENCE BETWEEN DOMESTIC VIOLENCE AND CIVIL HARASSMENT?
    Domestic violence cases are a special category of civil harassment. Civil harassment occurs when one person annoys, harasses, injures, or threatens another person. However, a civil harassment case does not have to meet the relationship test established for domestic violence. Domestic violence cases can often be more volatile than civil harassment cases. Because of the special relationship between the parties, a domestic violence case often results in greater harm caused by one person against the other. Many states have different procedures for domestic violence and civil harassment. In addition, the available remedies for a domestic violence case may differ from the remedies available in a civil harassment case.
    WHAT REMEDIES ARE AVAILABLE TO PREVENT FURTHER DOMESTIC VIOLENCE?
    Upon petition to the court, temporary or lengthy restraining orders (also referred to as "protective orders") may be issued. Orders issued in a domestic violence case may include:

    HEALTH CARE RESPONDS TO DOMESTIC VIOLENCE
    Office of the Illinois Attorney General Lisa Madigan Hospitals are a major resource for intervention, treatment, and social change. Because hospitals play an important role in the treatment of domestic violence, the Office of the Attorney General has worked to make every hospital emergency department in Illinois a domestic violence response site. Interdisciplinary hospital team members are taught the skills necessary for working with domestic violence victims. The teams learn to develop and implement policies and protocols for universal screening of women patients, to write and deliver staff training, and to make their emergency departments safe, confidential, and DV friendly. The Office of Attorney General also offers follow-up technical assistance and site visits to each hospital to encourage comprehensive and complete implementation of the project. This program has already begun to have a major impact on how victims of domestic violence are identified and assisted in medical facilities.     I. INTRODUCTION
    The New York State Office for the Prevention of Domestic Violence (OPDV) requests proposals from organizations located and operating in the State of New York to provide 24-hour, toll-free, statewide domestic violence hotline services as well as education and outreach through the distribution of up to date printed materials free of charge. Hotline services must specifically target English speaking and Spanish speaking callers, and accommodate callers speaking other languages. The contract period is three (3) years, with OPDV reserving the right to terminate the contract during the contract period depending upon availability of further funding and satisfactory performance by the contractor. All proposals must be received in the Albany office by 4:30 PM Monday, January 27, 2003.
