General Information About Domestic Violence Protection Orders
In a criminal domestic violence case:
Motion for a Temporary Protection Order ("TPO")
is the document that must be filed in a criminal case if a victim of domestic violence wishes to obtain a protection order against an alleged domestic violence offender. The criminal case must allege the offender committed domestic violence, felonious assault, aggravated assault, assault, menacing by stalking, of aggravated trespass against a family or household member.
Temporary Protection Order ("TPO") is the order the court issues in response to the Motion for Temporary Protection Order. The TPO requires the domestic violence offender to stop abusing and to stay away from the victim(s) named in the Motion for Temporary Protection Order. A TPO expires when the alleged domestic violence offender's criminal case ends or when a new CPO is issued based on the same incident(s) of domestic violence.
Complainant is the person asking the court for protection in the Motion for a Criminal TPO.

Domestic Violence Brochure The Domestic and Family Violence Task Force was formed in October, 1999 to look at domestic and family violence issues in connection with child abuse and neglect cases. Nearly 100 professionals from across the state have been working with the Attorney General's Task Force to focus on efforts to promote each child's right to a safe and permanent home, free from family violence. As a result of Task Force efforts for the first time in Arizona, domestic violence advocates will be available in the dependency court system to help self-identified victims of domestic violence whose children have been removed from their home by CPS due to abuse or neglect. In his opening address the Governor General, Sir Michael Hardy Boys said: "... we have to take account of the violence inflicted in a child’s sight or hearing on someone else, usually their mother or a sibling, usually by a husband, father or partner. Continued education about domestic violence is essential at the high-school and college levels, Attorney General Carla Stovall said Wednesday when she visited K-State. "Domestic violence should be called undomestic because there is nothing domestic about beating somebody," Stovall said. "We need to teach young people that it's not OK to hit and abuse." During her term as attorney general, Stovall has focused on educating state residents about domestic violence, increasing juvenile delinquency and child death rates. Kansas will have some assistance fighting crime when it receives $426,000 from the Federal Crime Bill in mid-December. The funds will be split equally between police, discretionary preceding, victim advocate groups and courts, Stovall said. The Kansas State Child Death Review Board, which Stovall assists, recently released an annual report on the causes of death for children under 18 in Kansas between July 1, 1993, and June 30, 1994. Research showed of the 466 child deaths that occurred during the study, 34 were homicides, 18 were suicides, 64 were caused by vehicular accidents, 31 were from non-vehicular accidents, 53 were caused by Sudden Infant Death Syndrome, 260 deaths were natural causes and six deaths were undetermined.

Ieyoub signed on today to a strong new package of steps targeting domestic abusers in Louisiana and the rest of the nation. General Ieyoub indicated his strong support for such steps as recognition across state lines of stay-away and similar protective orders, penalty enhancement for men who batter women in front of children, and victim-counselor confidentiality. General Ieyoub made the announcement today as he voted for the major new steps in the form of a resolution considered at the National Association of Attorneys General meeting in Washington, D.C. Attorney General Ieyoub made it clear that he intends to do whatever is needed to promote the reforms at the state and national level. "More than 1,000 women die each year as a result of domestic violence and studies show that half of all men who abuse their partner also abuse their children." said Attorney General Ieyoub.

    Governor’s Council on Domestic Violence and Sexual Assault In January 1996 Governor Paul Patton issued an Executive Order to create the state’s first Governor’s Council on Domestic Violence. He took that action with a belief that domestic violence needed organized attention from the highest levels of government and that there was a need to increase the awareness of the Commonwealth to the prevalence of the crime and its harmful effects. The Council proposed to Governor Patton that he include among his legislative proposals to the 2000 General Assembly a bill to make the Council statutory, thereby making successes like those accomplished during the first four years a permanent resource for Kentuckians. In the fall of 1999, Governor Patton created a time-limited task force to study the state’s response to the crime of rape against adults. He charged the Task Force with bringing legislative recommendations to him by January 1, 2000. Among the recommendations for legislation proposed by the Council was creation of a statutory body to give permanent focus to the crimes involving sexual violence. In response to the recommendations of the Governor’s Council on Domestic Violence and the Governor’s Task Force on Sexual Assault, the Governor and First Lady successfully proposed legislation to the 2000 General Assembly to create a Governor’s Council on Domestic Violence and Sexual Assault.

    Types of Abuse
    The main purpose of abuse is to maintain power and control (Ganley, 1996). Five forms of relationship violence exist; physical, emotional, economic, psychological, and sexual.
    • In physical abuse, a person attempts to inflict harm on another. This includes but is not limited to pushing, shoving, slapping, punching, hitting with a blunt object, stabbing or shooting.
    • In emotional abuse, one person attempts to undermine the other person's self-worth. Some examples would be constant criticism, belittling insults or manipulating feeling.
    • In economic abuse, the perpetrator puts the victim in a financially dependent position (Chez, 1994). The abuser decides how the money will be spent. This occurs several ways and across all economic classes. Some examples of maintaining financial control are, not allowing the victim to work. Another is making the victim keep detailed records of every penny spent. A third way is for the abuser to refuse to go to work.
    • Though instillation of fear, psychological abuse is the attempt ensure the victim only has the abuser to rely on. Threats of violence may be directed at the victim or may include suicide threats. Intimidation may be attacks on property, a loved one or pets. They may also be stalking, or screaming at the victims face. The abuser gains control through isolation and disinformation. It can be subtle or blatant. Subtle includes comments like wanting to be with the victim all the time because they love them so much. Disinformation tactics are lies perpetrators use to distort the victims sense of reality such as lies about legal rights (Ganley, 1996).

    Get to a Safe Place
    Request that the investigating officer or assistant district attorney assist in providing safety to you and your family. The officer can help you make arrangements to go to a domestic violence program, a family member's or a friend's home, or a similar place of safety. Request that the officer assist you in retrieving any necessary personal belongings from your home, such as clothing or medications. Request that the officer assist in obtaining any necessary medical treatment for you and your children. Request a copy of any incident reports at no cost from the law enforcement agency. The Family Protection and Domestic Violence Intervention Act of 1994 allows victims of domestic violence to receive assistance from their local law enforcement agencies and courts to ensure their safety. Seek Protection for You and Your Children If you are married to, divorced from, related to, or have a child with the person who committed the violent act against you, you may proceed in either Family Court or Criminal Court. If you are neither married nor related to and have no children with the person who hurt you, you will need to proceed to Criminal Court. The main difference between the two courts is that in Criminal Court, the District Attorney prosecutes the offender, while in Family Court, you and your lawyer file petitions against the abuser. The constabulary's Domestic Violence Policy promotes positive action, which is defined as: Protection, Prevention and Enforcement. The constabulary's undertaking is to treat domestic violence incidents as crimes and thereby collect evidence from all available sources. Officers are instructed to separate the parties to obtain a full account of the incident and any previous history. The importance of obtaining quality information is stressed and accurate record keeping becomes an essential part of the process to ensure that previous domestic violence incidents can be taken into account and potentially used in subsequent court proceedings. Officers are instructed on the need to deal as sensitively as possible in these highly complex situations and also to be alert to the needs of individual victims, particularly within our minority ethnic communities.
