Minority voters all over the city suddenly had representation, and voter turnout increased more than three times. More than 100 jurisdictions in the US have adopted such alternative voting systems to resolve voting rights lawsuits. Cumulative voting and limited voting have been used in Alabama, Illinois, New Mexico and South Dakota. More than 50 localities have adopted cumulative voting in Texas alone. Cumulative voting is just one method for allowing voters to make their voices heard. In March 2002, San Francisco voters supported instant runoff voting (IRV) for citywide elections by an impressive 55 to 45 percent margin, while citizens at over 50 town meetings across Vermont overwhelmingly voted to urge state lawmakers to adopt instant runoff voting for statewide elections. CIVIL ACTION NO. COMPLAINT Plaintiff Securities and Exchange Commission (the "Commission") alleges: Summary 1. This enforcement action involves material overstatements of revenue during 1998 by Inso Corporation ("Inso"), a publicly-traded company then headquartered in Boston, Massachusetts. Between approximately September 1998 and April 1999, Defendants Bruce Hill ("Hill"), then general counsel of Inso, and Graham Marshall ("Marshall"), then vice president and general manager of Inso's electronic publishing division, engaged in a fraudulent revenue recognition scheme designed to falsely boost the amount of Inso's third quarter and annual revenues for 1998. 2. By on or about September 30, 1998, the last day of Inso's 1998 fiscal third quarter, Inso's sales team had failed to conclude a sale of $3 million of software licenses to US Airways Group, Inc. ("US Airways") that Inso had been negotiating since at least early 1998. Although no distributor had been involved in this deal prior to the end of the third quarter of 1998, on or about September 30, 1998, Marshall and others at Inso attempted to locate a distributor who would place an immediate order for the $3 million of software licenses in order to allow Inso to record revenue from the transaction in the third quarter. 3. On or about September 30, 1998, Marshall contacted a potential distributor for the US Airways deal a software company located in Malaysia ("the Malaysian distributor"). Hill and Marshall then entered into a phony $3 million sales transaction with the Malaysian distributor. The sales transaction was a sham because of an undisclosed oral side agreement between Hill and Marshall and the Malaysian distributor which provided that Inso would sell the software to US Airways directly and that the Malaysian distributor would not have to pay for its supposed $3 million purchase.

An excerpt from a speech by Steven Hillgiven to the annual national convention of the Green Party USA, July 29, 1995. This is an exciting time for the hopes of third parties. There is a window of opportunity presenting itself to third party efforts that we haven't seen in the United States since the early decades of this century. We are facing a time of unprecedented voter apathy and alienation, even by the low standards of the United States and winner-take-all democracies. In the 1994 Congressional elections, eligible voter turnout was 36% 36%! That means two out of three people did not even go to the polls, and despite what Beltway-myopic pundits like George Will says, that's not because people are satisfied. Studies overwhelmingly show that those not voting are those with the lowest incomes and the lowest educational levels. In other words, those that have the least reasons to be satisfied. These people have simply given up voting, because they don't like what either of the two parties are offering. But I also want to voice a word of caution. As I sat and listened to the previous panel of Green Party candidates for various elective offices around the country, I noticed a disturbing trend. Several of the candidates made exuberant statements such as "I received five percent of the vote last time I ran, and this time I received seven percent; or nine percent; or Roberto Mondragon from New Mexico received 11%, etc." And while I want to heartily congratulate these candidates, and commend them for their initiative and commitment, I want to remind them and all Greens of a fairly obvious fact: they were still 40-45% short of winning! They weren't anywhere near receiving a majority or plurality of votes necessary to win their seat.
