, Vol. 14, No. 1, February 11, 2000 A U.S. district court in New York has ruled that the application of section 401(a) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (PRWORA) to deny Medicaid-funded nonemergency prenatal care to undocumented immigrants violates the due process rights of their U.S. citizen children. This is the first time an equal protection claim made by immigrant litigants against the PRWORA has prompted a court to apply heightened scrutiny to the statutory provision being challenged. This case, unlike previous constitutional challenges brought against the PRWORA by immigrant plaintiffs, warranted heightened scrutiny of the provision at issue, the court found. Because applying section 401(a) to deny nonemergency prenatal care to undocumented women would have the further effect of denying to their U.S. citizen children automatic eligibility for Medicaid (citizen children of similarly situated, otherwise qualified citizen mothers are considered automatically eligible for Medicaid), the court held that this disparate treatment of U.S. citizens based on a condition over which they had no control—i.e., the immigration status of their mothers—must be "substantially related to a legitimate congressional objective." Balanced against the costs to society that denying prenatal care would impose, as well as the potentially lifelong impact such a denial would have on individual children’s well-being, the court found that the defendants’ dual rationale—discouraging illegal immigration and encouraging immigrant self-sufficiency—failed to satisfy heightened scrutiny’s requirement that the government’s action further "some substantial goal." Accordingly, the court denied the defendants’ motion to vacate its permanent injunction.

    I'm trying to help a friend track down her Native American roots. We are just beginning. We are trying to find a Mary Lewis that married Bill or William Floyd. We think it is the Lewis family that was Native American but it could be both. They had children, William k, Gus and Ida Floyd. William K was born in 1890. We are going to AL soon to do research. Any sugestions on what library to go to? She has always heard her family was in the Trail of Tears.

    Amenazan con demandar a Lewis
    Por Associated Press Enviar esta página Imprime esta historia HAMBURGO, Alemania - El promotor del púgil ucraniano Vitali Klitschko amenazó con demandar al británico Lennox Lewis por incumplimiento de contrato si decide sostener su próximo combate contra Mike Tyson y no frente a su representado.
    Klaus Peter Kohl, el promotor alemán, visitó el martes Nueva York, donde intentará salvar el combate contra Lewis, campeón mundial pesado por el Consejo Mundial de Boxeo (CMB). Planea reunirse con el manager de Lewis, Adrian Ogen, y con el abogado del campeón, Judd Burnstein.
    "Nuestra posición es clara, o Lewis cumple el contrato para pelear con Vitali Klitschko o hay sólo dos posibilidades: buscaremos millones (de dólares) en los tribunales o será despojado de su título por el CMB", dijo Rainer Koppke, un portavoz de la compañía Universum Boxing, que promueve al retador.
    El lunes, Kohl dijo que él y Ogen, en representación de la empresa que maneja a Lewis, Lion Promotion, habían firmado en diciembre un contrato, el cual fijaba para abril el combate entre el campeón y Klitschko.
