Eldred founded Eldritch Press in 1995, hoping he could share rare and out-of-print books with a Web audience that otherwise might not be able to see such lost works. But thanks to the , signed into law 27 October, Eldred's hobby publishing rare books online could result in a jail sentence of up to six years. "This is not an instance of wanting to take money out of authors' pockets," Eldred said. "The only people who will benefit from this act are distant heirs of the author and publishing companies." Eldred's policy has been to publish classic works immediately after they entered the public domain. He had planned to include 1920s works like A. A. Fair Credit Billing H ave you ever been billed for merchandise you returned or never received? Has your credit card company ever charged you twice for the same item or failed to credit a payment to your account? While frustrating, these errors can be corrected. It takes a little patience and knowledge of the dispute settlement procedures provided by the Fair Credit Billing Act (FCBA). The law applies to "open end" credit accounts, such as credit cards, and revolving charge accounts - such as department store accounts. It does not cover installment contracts - loans or extensions of credit you repay on a fixed schedule. Consumers often buy cars, furniture and major appliances on an installment basis, and repay personal loans in installments as well. What types of disputes are covered? The FCBA settlement procedures apply only to disputes about "billing errors." For example:
  • unauthorized charges. Federal law limits your responsibility for unauthorized charges to $50;

TITLE XIII-CHILDREN'S ONLINE PRIVACY PROTECTION SEC. 1301. SHORT TITLE.
This title may be cited as the "Children's Online Privacy Protection Act of 1998". SEC. 1302. DEFINITIONS. In this title: (1) CHILD.—The term "child" means an individual under the age of 13. (2) OPERATOR.—The term "operator"— (i) among the several States or with 1 or more foreign nations; (I) another such territory; or (II) any State or foreign nation; or (iii) between the District of Columbia and any State, territory, or foreign nation; but (B) does not include any nonprofit entity that would otherwise be exempt from coverage under section 5 of the Federal Trade Commission Act (15 U.S.C. 45). (3) COMMISSION.—The term "Commission" means the Federal Trade Commission.     1. Introduction
    That uses of language not only can, but even normally do have the character of actions was a fact largely unrealised by those engaged in the study of language before the present century, at least in the sense that there was lacking any attempt to come to terms systematically with the action-theoretic peculiarities of language use. Where the action-character of linguistic phenomena was acknowledged, it was normally regarded as a peripheral matter, relating to derivative or non-standard aspects of language which could afford to be ignored.
    The reasons for this are largely historical. In the first chapter of his De interpretatione , Aristotle writes:
    Every sentence is significant [...], but not every sentence is a statement-making sentence, but only those in which there is truth or falsity. There is not truth or falsity in all sentences: a prayer is a sentence but is neither true nor false. The present investigation deals with the statement-making sentence; the others we can dismiss, since consideration of them belongs rather to the study of rhetoric or poetry. (17 a 1-5, Edghill translation)
    Aristotle's attitude remained authoritative until the end of the nineteenth century. There are, certainly, medieval writings on sacramental and other ritual and quasi-legal uses of language, as for example in connection with the issue as to what is involved in the constitution of a valid baptism or marriage. But such writings contain at best isolated passages capable of being interpreted with hindsight as belonging to a theory of speech acts. They exerted no wider theoretical influence in their own right, and they did not succeed in bridging the gap opened up by Aristotle between logical and other ("poetical") aspects of language use.
