    Introduction
    On October 26, 2001, President Bush signed the USA Patriot Act (USAPA) into law. With this law we have given sweeping new powers to both domestic law enforcement and international intelligence agencies and have eliminated the checks and balances that previously gave courts the opportunity to ensure that these powers were not abused. Most of these checks and balances were put into place after previous misuse of surveillance powers by these agencies, including the revelation in 1974 that the FBI and foreign intelligence agencies had spied on over 10,000 U.S. citizens, including Martin Luther King.
    A Rush Job
    The bill is 342 pages long and makes changes, some large and some small, to over 15 different statutes. This document provides explanation and some analysis to the sections of the bill relating to online activities and surveillance. Other sections, including those devoted to money laundering, immigration and providing for the victims of terrorism, are not discussed here. Yet even just considering the surveillance and online provisions of the USAPA, it is a large and complex law that had over four different names and several versions in the five weeks between the introduction of its first predecessor and its final passage into law. While containing some sections that seem appropriate providing for victims of the September 11 attacks, increasing translation facilities and increasing forensic cybercrime capabilities it seems clear that the vast majority of the sections included have not been carefully studied by Congress, nor was sufficient time taken to debate it or to hear testimony from experts outside of law enforcement in the fields where it makes major changes. This concern is amplified because several of the key procedural processes applicable to any other proposed laws, including inter-agency review, the normal committee and hearing processes and thorough voting, were suspended for this bill.

The Model Drug Dealer Liability Act Homepage: Welcome to the Model Drug Dealer Liability Act (DDLA) website. The DDLA provides a means for parents and others to obtain monetary damages from drug dealers for the injuries caused by drugs to their families and communities. The Model DDLA has now has been adopted by fourteen (14) state legislatures throughout the United States. Under its "market liability" provisions the DDLA provides for civil liability for any drug dealer in a community for the injuries to others by drug users of the same type of drug, during the time period the dealer was dealing in the same community. Under "market liability" a plaintiff need not prove that the particular defendant drug dealer was in the "chain of distribution" to the user that caused the injuries. The Act is Model legislation of the American Legislative Exchange Council which is a bi-partisan organization of over 2,500 legislatures throughout the country. The Model Act was drafted by Daniel Bent with the help of Assistant U.S. Attorney Sharon Burnham and the input of scores of other experienced attorneys. Mr. Bent has twenty-five years experience as a trial lawyer. He was appointed by President Reagan and confirmed by the Senate as a United States Attorney, a position in which he served for 10 years. As a federal prosecutor he tried drug kingpin, drug dealer tax/ money laundering, major fraud, organized crime and other significant cases. He also has years of civil litigation experience. In drafting the Model Act, it was "vetted" by numerous other attorneys, including a distinguished civil rights expert who is now an appellate judge, as well as other experts in economics, commerce, and the illegal drug market itself. This extensive drafting process was to insure that the Model Act provides a lawyer representing a victim of someone's drug use a

Introduction: The New Legislation

The new law offers many improvements over the previous version of Section 110(2), but in order to enjoy its advantages, colleges, universities, and other qualified educational institutions will need to meet the law's rigorous requirements. Educators will not be able to comply by either accidental circumstances or well-meaning intention. Instead, the law calls on each educational institution to undertake numerous procedures and involve the active participation of many individuals.

Benefits of the TEACH Act
The primary benefit of the TEACH Act for educators is its repeal of the earlier version of Section 110(2), which was drafted principally in the context of closed-circuit television. That law permitted educators to "perform" only certain types of works and generally allowed transmissions to be received only in classrooms and similar locations. These restrictions, and others, usually meant that the law could seldom apply to the context of modern, digital transmissions that might utilize a range of materials and need to reach students at home, at work, and elsewhere. The new version of Section 110(2) offers these explicit improvements:

The proposed False Claims Act reform initiative also may be an indicator to defense counsel that potential jurors will be receptive to arguments of government overreaching in its penalizing of innocent misbilling claims. Materiality and the Wells Case: The Supreme Court Removes Materiality from Section 1014 Prosecutions Contrary to the holdings of the vast majority of circuits, the Supreme Court held that materiality was not an element of a section 1014 violation. In so ruling, the Supreme Court found the plain language of the statute and its legislative history to be controlling. The language of section 1014 nowhere requires that a material fact must be the subject of the false statement. In fact, the statute never even mentions materiality. Materiality and the Criminal False Claims Act: The Impact of Wells Whoever makes or presents to any person or officer in the civil, military, or naval service of the United States, or to any department or agency thereof, any claim upon or against the United States, or any department or agency thereof, knowing such claim to be false, fictitious, or fraudulent, shall be imprisoned . . . .

R. W. Cooke-Taylor, the author of The Factory System was also an Inspector of Factories. In his book he explained the 1802 Factory Act. The first Factory Act ever passed by the British Parliament was called "The Factory Health and Morals Act, 1802" and applied principally, though not exclusively, to apprentices in cotton and woollen mills. The preamble runs as follows:
"Whereas it hath of late become a practice in cotton and woollen mills, and in cotton and woollen factories, to employ a great number of male and female apprentices, and other persons, in the same building, in consequence of which certain regulations are now necessary to preserve the health and morals of such apprentices."

The Combination Laws passed in 1799 made it illegal for workers to join together to press their employers for shorter hours or may pay. As a result trade unions were thus effectively made illegal. The campaign against this legislation was led by the trade union leader, Francis Place . In the House of Commons, Joseph Hume and Sir Francis Burdett led the fight against the Combination Laws
The legislation remained in force until they were repealed in 1824. This was followed by an outbreak of strikes and as a result and further legislation was passed. The 1825 Combination Act narrowly defined the rights of trade unions as meeting to bargain over wages and conditions. Anything outside these limits was liable to prosecution as criminal conspiracy in restraint of trade. Trade unionists were not allowed to "molest", "obstruct", or intimidate" others. Introduction
The Disability Discrimination Act (DDA) aims to end the discrimination which many disabled people face. This Act gives disabled people rights in the areas of:
  • employment access to goods, facilities and services buying or renting land or property.
The employment rights and first rights of access came into force on 2 December, 1996; further rights of access came into force on 1 October, 1999; and the final rights of access will come into force in October 2004. In addition this Act:
  • allows the Government to set minimum standards so that disabled people can use public transport easily.

The US expects a long-term conflict
US President George Bush has said Tuesday's attacks on the World Trade Center and the Pentagon were "an act of war". Speaking from the White House, Mr Bush said the US would rally the world to defeat those who had carried out the attacks.
This battle will take time and resolve, but make no mistake about it, we will win
President Bush Nato ambassadors invoked a mutual defence clause in the organisation's founding treaty for the first time in its history. It envisages a collective response to armed attack against one of its members. "Accordingly, the United States' Nato allies stand ready to provide the assistance that may be required as a consequence of these actions of barbarism," a statement by the Nato council said. FBI Director Robert Mueller told a news conference that several of the hijackers as well as possible associates still in the US had been identified.
