    The Critical Theory of Jurgen Habermas
    Jurgen Habermas is widely considered as the most influential thinker in Germany over the past decade [1970-80]. As a philosopher and sociologist he has mastered and creatively articulated an extraordinary range of specialized literature in the social sciences, social theory and the history of ideas in the provocative critical theory of knowledge and human interests. His roots are in the tradition of German thought from Kant to Marx, and he has been associated with the Frankfurt School of critical theorists which pioneered in the study of the relationship of the ideas of Marx and Freud.'     Habermas' Three Generic Domains of Human Interest
    Habermas differentiates three primary generic cognitive areas in which human interest generates knowledge. These areas determine categories relevant to what we interpret as knowledge. That is, they are termed 'knowledge constitutive' they determine the mode of discovering knowledge and whether knowledge claims can be warranted. These areas define cognitive interests or learning domains, and are grounded in different aspects of social existence work, interaction and power.
    Work Knowledge
    Work broadly refers to the way one controls and manipulates one's environment. This is commonly known as instrumental action knowledge is based upon empirical investigation and governed by technical rules. The criterion of effective control of reality direct what is or is not appropriate action. The empirical-analytic sciences using hypothetical-deductive theories characterize this domain. (Paregoric was opium-based and therefore, also, was potentially a danger to you.) Because of the hard and forbidding quality of most of his paragraphs (now and then a blessed lucidity shines through, especially when he summarizes Kohlberg's empirical psychology), Habermas benefits mightily from the aid provided in the Introduction by McCarthy. (At least we benefit.) We summarize McCarthy's few pages with some detail because they seem so clear, in contrast to the Habermasian hardness that follows. McCarthy, first of all, portrays Habermas as someone thinking about how to live in a MODERN world that has lost "value-imbued cosmologies" and that has seen the "disintegration of sacred canopies" [great phrase].(vii) McCarthy puts it this way for Habermas:

Andrew Page EADU Fall 2000 A Bio of Jurgen Habermas (1929) Key Habermasian Terms Critical Theorist, theory of rationality, communicative action German philosopher and social theorist, a leading representative of the Frankfurt School. This school of thought developed at the Institute for Social Research founded in Frankfurt, Germany, in 1923, and it introduced a style of analysis known as critical theory. Critical theory draws on the ideas of German political philosopher Karl Marx in its studies of the sources of domination and authority in society that restrict human freedom. Habermas was born in Düsseldorf. After studying philosophy at the Universities of Göttingen and Bonn, he worked briefly as an assistant to philosopher Theodor Adorno at the Institute for Social Research. In the 1960s and 1970s Habermas taught at the University of Heidelberg and the University of Frankfurt and served as director of the Max Planck Institute in Starnberg. In 1983 Habermas returned to the University of Frankfurt, where he was a professor of philosophy until his retirement in 1994. Habermas’s main contribution to philosophy has been the development of a theory of rationality Running through his work is a critique of Western industrial democracies for their reduction of the human world to some form of economic efficiency. According to Habermas, rationality—that is, the ability to think logically and analytically—is more than a strategic calculation of how to achieve some chosen end. Instead, rationality is a form of “communicative action” oriented toward attaining agreement with others. Thus, it is imperative that in using language we participate in what Habermas called an “ideal speech situation.” In this situation, citizens put forward moral and political claims and defend them on the basis of rationality alone.

In this seminar we will interrogate the relationship between law, state and politics by focussing on debates around, and theories of, rights. We will be concerned primarily with the problems posed for rights, law and constitutionalism by processes of globalization involving claims for cultural recognition, by the massive increases in the movements of peoples across borders raising questions of political membership and incorporation, and by increasing cultural heterogenity within nation-states. These issues are raised by concentrating on some of the major authors including Habermas, Santos, Benhabib, Tully, Taylor, McCarthy, Honig and Cohen and by focussing on struggles for recognition, "constitutional patriotism" as a form of civic nationalism and group-differentiated rights. Throughout the course we will be concerned with the philosophical/sociological problem of the contours of post-metaphysics which renders rights and justice "without guarantees."
