    Rawls, John
    Rawls, John, 1921-, American philosopher and political theorist, b. Baltimore, grad. Princeton (A.B. 1943, Ph.D. 1950). He taught at Princeton (1950-52), Cornell (1953-59), and Massachusetts Institute of Technology before becoming (1962) professor of philosophy at Harvard. Rawls's chief work is A Theory of Justice (1971), in which he attempts, within the social contract tradition of John Locke , Jean Jacques Rousseau, and Immanuel Kant , to offer an alternative to utilitarian political philosophy. His system is developed from two basic principles: Each person has a right to the most extensive basic liberty compatible with like liberty for others; and inequalities in the distribution of wealth and power are just only when they can be reasonably expected to work to the advantage of those who are worst off. For Rawls, justice does not require equality in social position, but it does require that people share one another's fate. By providing the social contract tradition with a formidable philosophic defense, Rawls's book revived interest in systematic political theory.

Rawls develops the idea of an impartial social contract to justify these principles: Free persons, equally situated and ignorant of their historical circumstances, would rationally agree to them in order to secure their equal status and independence, and to pursue freely their conceptions of the good.     With the death of John Rawls, from heart failure at the age of 81, the English-speaking world lost its leading political philosopher. An exceptionally modest and retiring man, with a bat-like horror of the limelight, he consistently refused the honours he was offered, and declined to pursue the career as public commentator or media guru opened to him by his achievements. Nevertheless, after its appearance in 1971, his most important book, A Theory Of Justice - written during the Vietnam war - became required reading for students of philosophy, politics and law, and, in that way, Rawls has influenced several generations. Indeed, the book, which sold more than 300,000 copies in the US alone, more or less singlehandedly rejuvenated and transformed the study of political philosophy.

    General Conception
    All social primary goods - liberty and opportunity, income and wealth, and the bases of self-respect - are to be distributed equally unless an unequal distribution of any or all of these goods is to the advantage of the least favored.
    Social Contract
    John Locke: Free people need to agree on some ground rules in order to live together in harmony.
    Utilitarianism
    John Stuart Mill and Jeremy Bentham: Act so as to maximize good (pleasure) in the aggregate. Later twist: minimize pain. From either perspective, your actions are judged good or bad depending on the consequences they have for you and for others. "The greatest good for the greatest number" can be abused, leading to the "tyranny of the majority" (e.g., Nazi Germany's mistreatment of the Jews and the United States' mistreatment of African Americans). Rawls' approach guards against this common source of injustice.

    R.J. Kilcullen John Rawls, professor of philosophy at Harvard, published a paper in the Philosophical Review for 1958 called 'Justice as Fairness', followed up by various other papers, and in 1971 a large book A Theory of Justice . Rawls disagrees with the Utilitarians over their way of spelling out the idea of the happiness of mankind generally. They say: Consider whether the act, rule or institution to be evaluated is best for the happiness of mankind generally. The difficulty is that often it will be both to the advantage of some people and to the disadvantage of others. The effect on the happiness of mankind generally has to be assessed by somehow balancing off the bad effects on some people against the good effects on others. There is no way of avoiding this. Some of the practical questions we have to decide do involve choice between possible courses of action all of which have good effects on some people and bad effects on others. If a political or ethical theory can't give us any guidance on deciding questions like that then it is almost useless. Questions of distributive justice especially call for decisions between conflicting interests - if some get more others get less. So the effect on the happiness of mankind generally will be the

    3 The priority of liberty
    Let us turn now to the third of the distinctive features of Rawls's theory, the priority of liberty.
    Liberty
    ('Freedom' and 'liberty' mean the same.) In 20th century political philosophy some have favoured a 'negative' concept of liberty (freedom from constraint) and criticised 'positive' notions of liberty ('freedom to') as incipiently authoritarian. According to Rawls every liberty is both negative and positive. That there is a certain liberty means that a certain person (or persons, or all persons) is (are) not under certain constraints, so that they can do a certain sort of thing (see p. 202). There are many possible liberties, including freedom of speech, freedom of conscience, religious freedom, freedom of the person (the rule of law, freedom from arbitrary arrest), freedom to acquire private property, certain political rights (the right to vote, to stand for office), etc. (American constitutional debates have produced a large literature on these topics; see for example M. Konvitz, Fundamental Liberties of a Free People .) Rawls does not discuss these in detail. Those who are poor, ignorant, lack the means, may not be able to take advantage of their rights (or liberties). Some writers have suggested that such circumstances (e.g. poverty) may violate such rights, thus building into the concept of the right the circumstances that make it possible to exercise it. Rawls does not follow this line. He does not say that poverty etc. violate or restrict the right; he says that they diminish its worth or value to the individual who has it. Thus he distinguishes between the right or liberty and its value or worth.

    "A Theory of Justice" Thanks to this book, many people consider Rawls to be the most influential philosopher of the late 20th century.
    Even a lot of politicians have read Rawls' book!
    He is now getting on in years, and has not been entirely well lately, but he is still at Harvard University.
    In his book, Rawls used a bunch of catchy phrases and terms that have really caught on among social and political thinkers. So you can often tell if a person is familiar with Rawls' theory just by the way they talk!
    Justice As Fairness
    • Rawls' theorywhich he often calls justice as fairness is an example of a social contract theory. Rawls' ideas have a little bit in common with the social contract theories of Hobbes and Rousseau and Locke.
    • Rawls mentions Kant's Categorical Imperative and the rule about treating person only as ends and never as means, so people also tie Rawls' theory back to Kant.
    • Rawls' theory is considered a liberal theory , meaning primarily that he is in favour of a society which is designed to help out the less fortunate individuals.
    Here are the key features of Rawls' theory:
    The Original Position
    Recall that Hobbes and Locke and Rousseau each described a state of nature. The state of nature was mainly just a useful idea; Hobbes said that humans never were actually in the state of nature. Hobbes described how people could leave a state of nature by a hypothetical social contract.
